This…would basically amount to *actually* stealing a seat. It’s incredible that this is about to succeed, and it’s crazy that it’s not getting more attention.
Justice Jackson’s line of questioning was actually pretty nuanced and also quite legally technical. The question before the court was whether the gender-transition ban counted as sex-based discrimination. She argued that the state’s argument—that because all children were treated the same regardless of sex under the ban, this was not sex-based discrimination—reminded her of the losing argument in Loving v Virginia: that regardless of whether people were black or white, they were not allowed to marry the other race. Similarly, regardless of their sex, kids can’t get cross-sex hormones for gender dysphoria in Tennessee. So the comparison is not so discordant as it might seem on its face.
In Loving, Virginia argued that laws prohibiting interracial marriage applied to both races in the same way that Tennessee argued that laws against gender affirming care applied to both sexes.
It's confusing because Justice Jackson is very smart and most blue checks not so much.
As President, I will always honor tribal sovereignty, respect tribal self determination, and fight for a future where every Native person can realize their aspirations.
@JenniferJillS @megynkelly@DailyMail No evidence of that despite claims on Twitter by some. Just that she has higher rates of testosterone. But she has always competed in the women’s category, she even competed in the 2020 Olympics and didn’t even medal.
While the media is consumed with last night's debate, this decision will shape how American government functions for decades, no matter who wins in November.
I cannot express enough how much the entire basis of the administrative state has just been thrown into the air. This is a huge power grab by the judicial branch, which will now exercise a level of control over the executive branch that is utterly unprecedented in the modern era.
Finally read the Uri Berliner piece on NPR biasand I'm baffled by how little the enormous media controversy it spawned has resulted in scrutiny of its claims for factual accuracy. There are significant problems with the piece including obvious, verifiable falsehoods
