Also where a person feel that he's unlawfully detained, he can seek for remedies, notwithstanding that he's guilty of what he's accused of, which led to his detention.

Understanding their differences will make you appreciate the premise of @Esq_Dalmas_J's advice to his client(the vendor/seller) to rescind the contract.

Where it's deposit that's being paid and the buyer/purchaser defaults the seller/vendor can rescind the contract and forfeit the deposit paid as a remedy unlike when it's part payment.
