In a major ruling for trademark protection in the pharmaceutical sector, the Bombay High Court has permanently restrained two companies from manufacturing and selling medicines under the brand name MEFIAL-SPAS, holding that it closely resembled the well-known MEFTAL-SPAS brand of Blue Cross Laboratories.

The court found that the rival product copied not only the brand name but also the packaging, colour scheme and overall appearance, making it likely to confuse consumers. Justice Arif S. Doctor observed that the similarities were visual, phonetic and deceptive in nature. While the court declined to award damages due to lack of evidence regarding financial loss, it directed the two defendant companies to pay litigation costs of ₹5 lakh each, totaling ₹10 lakh, within eight weeks.
