🚔Rusk, Texas — Sgt. D. Daily, Rusk PD, rolled up on Travis Heinze parked at the baseball complex after callers flagged a vehicle with covered windows as “suspicious.” Kids in the area were mentioned.

Not a traffic stop. No alleged crime. Covered windows for sun.

She asked for his license/ID repeatedly. He declined, noted it wasn’t a stop, offered to exchange IDs, and asked for the statute. She ran the plates.

Texas Penal Code 38.02 generally requires a lawful arrest before “failure to identify” applies. Parked + covered windows ≠ automatic ID demand.

Encounter stayed verbal. She advised him to uncover the windows and left.

No arrest.

❓If the callers never identified themselves, how much weight should those calls carry?

❓After watching the footage, was this contact justified, overreach, or somewhere in between?
