RE: NIGERIA AGENTS IN FINLAND COURT UNHAPPY ABOUT OPEN COURT DISCLOSURE

Our attention has been drawn that Nigeria agents sitting in Kouvola court are not happy that what Prime Minister Simon Ekpa said in *FINLAND OPEN COURT* was brought out to Biafrans.

We wish to state as follows:

1. Kouvola proceedings are OPEN COURT. Under Finnish law, open court means public. There is no secrecy. What is said in open court belongs to the public. Biafrans have right to know what their Prime Minister said in their defence.

2. If Nigeria agents are angry that truth came out, it confirms PM told truth. PM stated:

- USB declared in Lahti Nov 29, 2024 with 40 States — meets Montevideo 1933

- USB Independence Declaration in Lahti is part of the PROCESS to our full protection and freedom

- USB Constitution in exile is legal and cabinet can use it

- Dr Orabueze represents the ONLY leader of the 80 million Biafrans at this moment:

One Government:
One Constitution:
One Decaration

This truth hurt Nigeria agents because it exposes Nigeria and their Biafra agents fighting our freedom and declaration

The Finland open court hurts Nigeria as a terrorist state, not Biafra.

3. We will not hide open court from Biafrans. Open court is not secret meeting. Biafrans funded this struggle, Biafrans are the people. We will continue to brief Biafrans on every open court statement.

4. Nigeria agents should leave Finland court. If they are in Finland to intimidate and to stop Biafrans from hearing their Prime Minister, they are interfering with Finnish open justice. We ask Finnish court to note their presence.

5. Finland court conducts secret hearing during PMs appeal and the public were not allowed into the court. Nigeria agents should understand the difference between Finland open court and secret court hearings.

Open court is open. We will not be intimidated.

My Client Simon Ekpa is the Prime Minister of a government in exile declared in Lahti Finland November 29, 2024 with 40 States. This FACT should strip Finland the power to try and hold Simon Ekpa

The USB Government will ESCALATE this case if not satisfied to the EU Human Rights Court where we have already filed.

MEMORANDUM ON INTERNATIONAL LAW: USE OF CONSTITUTION BY A GOVERNMENT IN EXILE PENDING RECOGNITION*

Under Montevideo Article

1, PM Simon Ekpa and his government meets population, territory, government, capacity. Under Article 3, political existence is independent of recognition. Therefore use of constitution in exile is lawful and is evidence of peaceful political activity, not terrorism."

1. LEGAL QUESTION:

Can a new nation use its constitution while in exile and while waiting for international recognition?

Answer: YES. This is standard practice under international law.

2. LEGAL BASIS:

A. Montevideo Convention on Rights and Duties of States (1933) Article 1:*
"The state as a person of international law should possess: (a) permanent population (b) defined territory (c) government (d) capacity to enter into relations with other states." USB Met all criteria

Article 3: The political existence of the state is independent of recognition by other states.

Recognition is declaratory, not constitutive. Statehood exists when criteria are met, not when others recognize it.

B. ICCPR Article 1 & African Charter Articles 19, 20:

"All peoples have the right to self-determination. By virtue of that right they freely determine their political status."

3. GOVERNMENT IN EXILE — RECOGNIZED CONCEPT:*

A government in exile may:
- Adopt and use a constitution
- Establish cabinet and institutions
- Operate from host state or anywhere it choses
- Issue documents, structure administration

The constitution provides *internal legitimacy and rule of law* — proof of peaceful political organization.

4. PRECEDENTS:

1) State of Palestine — Declared in Algiers, 1988: Granted UN Observer State 2012. Constitution used before recognition.

2) Sahrawi Arab Democratic Republic — 1976:
Declared in exile, constitution adopted, governs refugee camps, 40+ recognitions, AU member — still waiting full UN recognition.

3) Kosovo — 2001-2008:
Operated under Constitutional Framework while under UN administration. Declared independence 2008 using that framework.

4) Israel — 1948:*
Declared state May 14, 1948, immediately applied Declaration as legal basis, then received recognition. Government functioned before recognition.

5. APPLICATION TO UNITED STATES OF BIAFRA:

- *Declaration:* November 29, 2024, Lahti, Finland — 40 States
- *Population:* Biafran people
- *Territory:* 40 States as defined in Constitution and confirmed by PM in Lahti appeal court
- Government: Deputy Prime Minister, Prime Minister + Cabinet + Ministries + 40 state governors and commissioners+ Mission Heads, County Heads, District Heads,ward Heads

Constitution: Provides structure, rule of law, separation of powers

Use of constitution in exile by USB mirrors Palestine in Algeria. It evidences peaceful self-determination, not criminal activity.

6. CONCLUSION:

Under Montevideo and ICCPR, a people may declare statehood, adopt a constitution, and operate as government in exile pending recognition. The existence of a constitution is evidence of lawful political organization.
