Wow wow wow! The Supreme Court’s recent handling of the stray dog case is a chilling display of judicial bias and a complete disregard for the laws of the land. 🏛️
​During the latest hearing, when Senior Advocate Kapil Sibal pointed out the "inhuman" reality of removing dogs without functional shelters, Justice Sandeep Mehta responded by saying, "On the next date, we will play a video... and ask you what is humanity."
​Let’s talk about that "Humanity":
​Is it "humane" to pass sweeping orders to "clear the streets" when the MCD has admitted it has ZERO functional shelter capacity? Justice Vikram Nath’s dismissive response—"Let them do it, we will consider"—is an open invitation for municipal authorities to engage in illegal culling and brutal displacement throughout December.
​The Judiciary is choosing ignorance over science and law:
​1️⃣ Defying Statutory Rules: The Animal Birth Control (ABC) Rules 2023 are NOT suggestions; they are central laws. They mandate that dogs must be returned to their original territory. By ordering permanent removal and relocation, the Court is effectively telling local bodies to break the law.
2️⃣ Promoting Cruelty: Forcing territorial animals into overcrowded, non-existent "pounds" is a death sentence. It leads to starvation, disease, and horrific infighting. This isn't "public safety"—it's state-sanctioned cruelty.
3️⃣ Judicial Ignorance of Science: The Bench’s comments—like "space for animals, no space for humans"—ignore the "Vacuum Effect." Removing a sterilized, stable population only makes room for un-vaccinated, aggressive dogs to move in. The judges are fueling a panic that actually increases the risk of rabies and bites.
4️⃣ Apathy Toward Ground Reality: While the judges threaten to play videos of dog bites, they ignore the videos of municipal workers dragging dogs by their necks, dumping them in forests, or leaving them to die in cages.
​"Humanity" isn't found in populist, knee-jerk reactions that punish sentient beings for administrative failure. If the MCD failed to sterilize dogs for a decade, the punishment should be on the officials, not the animals.
​We don't need "large-hearted" comments or lectures on humanity from a Bench that seems intent on bypassing the Prevention of Cruelty to Animals Act. We need a judiciary that upholds the law instead of encouraging a massacre. 🛑✊
