KRATOM SMALL BUSINESSES NEED TO PAY ATTENTION TO HB 968 IN GEORGIA
The March 6 substitute no longer simply bans all natural kratom but what it proposes could still be devastating for small businesses.
It would require natural kratom sold in Georgia to come from a kratom plant grown in the United States, require a licensed pharmacist to be present or available remotely at the point of sale, require buyers’ names, addresses and government ID information to be entered into a real-time electronic tracking system accessible to law enforcement, prohibit multi-serving packages and pressed tablets, and impose additional marketing restrictions.
That is not simple consumer protection.
That is a massive compliance burden that many small businesses will not be able to afford.
Large corporations may be able to absorb pharmacist costs, tracking systems, packaging changes and sourcing restrictions.
Small family-owned businesses? Many won’t.
Protect consumers. Regulate responsibly. Go after dangerous synthetic and high-potency products.
But don’t create a system so expensive and restrictive that only the biggest companies can survive.

Marion County Just Hit Pause on a Kratom Ban — Here’s Why
Commissioners agreed to wait on federal action targeting synthetic products after public speakers and staff warned that a blanket local ordinance could unfairly punish traditional leaf users and responsible businesses.
During public comment, one speaker described how a local business, Muddy Lotus Tea, has provided a safe space for a family member who struggles in most public settings. The speaker acknowledged legitimate concerns about concentrated kratom extracts, synthetic 7-OH, and related analogs, supporting efforts to keep dangerous products out of the community. However, the speaker urged the board to distinguish between those products and traditional leaf, warning that a blanket ban would unjustly restrict peaceful residents and responsible businesses not causing the harm officials seek to prevent.

One name covers all forms.
Two different shelves, but one name printed on both. Here is the critical difference between how federal action and state emergency orders approach product regulation.
There is a convenient narrative in the anti-kratom community that everyone who manufactures or sells kratom must be motivated by greed.
That has not been my experience.
My relationship with kratom was personal long before it was commercial. During some very difficult health challenges, kratom meaningfully improved my quality of life. That experience is part of what ultimately brought me into this industry.
And when I look at many of the legitimate manufacturers and operators I respect most, I see a similar pattern. They did not discover kratom on a spreadsheet. They had a personal experience with the plant, watched it help someone they cared about, or became genuinely interested in its potential—and then built businesses around it.
Of course businesses need to make a profit. Employees have to be paid. Facilities, laboratories, clinical research, insurance, GMP systems and regulatory compliance cost real money.
But profit and purpose are not mutually exclusive.
If making easy money were the sole objective, there are thousands of simpler industries to choose from than one facing regulatory uncertainty, litigation risk, payment-processing problems, import challenges and constant public scrutiny.
There is also an important distinction being lost in the current debate: the traditional kratom industry and the high-potency 7-hydroxymitragynine market are not the same thing. In my experience, the established kratom companies that built this category around the natural plant were not the companies driving the emergence of the concentrated 7-OH market. That market developed through a very different manufacturing culture and business model.
It is intellectually lazy to reduce every person in an industry to “greed.”
People have stories. People have motivations. Many of us entered this space because the plant affected our lives first—and the business came afterward.
Judge companies by how they operate: their science, manufacturing standards, transparency, surveillance, compliance and willingness to protect consumers.
That is a much more serious conversation than simply calling everyone who earns a living “greedy.”
