The political question doctrine wrongly assumes ‘political questions’ and ‘legal questions’ can be separated so clearly that the distinction can form the basis of practical solutions in litigation before the courts. See excerpt below from my Administrative Law book.

Folks may not be happy with Section 45 of the 2010 Constitution of Kenya on family and marriage. Article 45 (2) explicitly PERMITS marriage by persons of the opposite sex, or gender, BUT nowhere does Article 45 explicitly PROHIBIT same-sex marriages or marriage by persons of the same gender. If the drafters intended to prohibit same sex marriages, they failed to so state in clear and unambiguous language. The Constitution appears to have left that issue for interpretation by the courts, or legislation.
I don't celebrate Prof @makaumutua because he is my buddy. I celebrate Prof because he is Kenya's foremost legal scholar and distinguished academician....He is a great warrior in the fight against JurisPESA judges...we need to attend this debate/lecture.
It is Senior Paul Mwangi that got it right in this ODM double faceted teams, that it represents Raila on both sides of the coins:
1. The Compromising Oburu side was his entry strategy into Broad-based Government ✅️
2. The Militant Sifuna side was his exit strategy in case things were not going to work✅️
3. All these was speaks of Raila's complexity such that he is one you could not box into a corner.✅️
Based on the JSC interviews for Judges I would highly recommend this amazing book by Justice Lenaola… it covers the general topics in constitutional law and litigation of fundamental rights and freedoms…🤔

If it is for reasons like this that he’s denied the seat, that will be a shame. This is something he can learn quickly, and really shows us little about his ability. What we need more on the bench are not masters of details but careful thinkers and his acumen there is top top.
That a whole credible Professor of Law can be reduced to the test of a Rule 5(2)(b) negative order to determine if they suit the CoA Judgeship, is just the unfortunate misconceived belief that 'Academics' somehow need 'Orientation on the bench' & 'are inadequate due lack of litigation.' How do we Academics transmit & generate knowledge In law schools but suddenly a knowledge-answer Question becomes all we take them to be/not be.

For 60 years Kikuyus were sold the devil's portrait in the name of Jaramogi Oginga Odinga and Raila Odinga. This worked magic as a tool of political Mobilisation. After all the church can survive without angels but not without a devil to fight. It was wrong. On behalf of the Kikuyu community and Mt Kenya people at large, I offer my unqualified and profuse apology to the Luo Nation. At the same time, two wrongs do not make a right, Neither Uhuru Kenyatta nor Kikuyus are an enemy of the Luo Nation. Do not allow us to be turned. Into a tool of political Mobilisation. We can't sustain a devil narrative for another 60 years
