not a lawyer but, as usual, obviously depends on state. that would most likely be a justified shooting by a law enforcement officer, especially if that gesture is preceded by threats like "i'm going to kill you, watch what happens, etc" and/or compliance orders to keep his hands visible.

as a civilian, would not be a justified shooting. no visible gun or weapon drawn is the main thing. if he drew a gun, it wouldn't have to be pointed at him to legally assume there is an imminent threat.

beyond that, i think that's where it gets complicated and depends on the state, like if he pulled out a different deadly weapon such as a knife.
