シルバーウィークが近づき、行楽地などへのお出かけの際に、自動車を利用される皆様も多くいらっしゃると思います。

令和7年中は、交通事故による死者数が2,547人（前年比-116人、-4.4%）と、統計が残る昭和23年以降で最少を更新しました。
しかし、飲酒運転や大幅な速度超過といった「悪質な運転行為」による悲惨な交通事故は後を絶ちません。

こうした「悪質な運転行為」に対して、より厳正に対処するため、本年6月、『自動車運転死傷処罰法』と『道路交通法』を改正しましたので、ご紹介します（本年7月21日から施行）。

＜『自動車運転死傷処罰法』の改正について＞

『自動車運転死傷処罰法』に規定されている「危険運転致死傷罪」は、「危険・悪質な運転行為」によって人を死傷させた者について、最高で20年の拘禁刑という刑を科すものです。

しかし、どのような行為が、「危険・悪質な運転行為」、例えば「アルコールの影響により正常な運転が困難な状態で自動車を走行させる行為」に該当するのかといった判断にばらつきが生じやすく、適用が難しいという問題がありました。

そこで、今回の改正により、「危険・悪質な運転行為」の明確な基準を定め、その基準を超えた場合には、一律に
・「アルコールの影響により正常な運転が困難な状態で自動車を走行させる行為」や
・「道路・交通の状況に応じて重大な交通の危険を回避することが著しく困難な高速度で自動車を運転する行為」
に該当し、「危険運転致死傷罪」の対象とすることとされました。

具体的な「基準」は、
・アルコール：　呼気中アルコール濃度0.5mg/l以上
・高速度：　最高速度が60km/h以下の場合　最高速度+50km/h以上
最高速度が60km/h超の場合　最高速度+60km/h以上
です。

なお、基準未満であっても、一定の要件を満たせば、「危険運転致死傷罪」の対象となります。

また、公道上で、
・やむを得ない事情がないのにあえて車体を横滑りさせながらカーブを曲がる
・二輪車の前輪を浮かせて後輪だけで走行する
などの行為によって死傷事故を起こした場合などについても、新たに「危険運転致死傷罪」の対象に追加されました。

＜『道路交通法』の改正について＞

人を死傷させる事態に至らなくても、「酒酔い運転」は、『道路交通法』により、最高で５年の拘禁刑が科されます。

今回の改正により、「酒酔い運転」についても、
・呼気中アルコール濃度0.5mg/l以上
という明確な「基準」が新たに設けられました。

こちらについても基準未満であっても、一定の要件を満たせば、「酒酔い運転」の対象となります。

これらは、一律に重く処罰される基準であって、決して、基準を超えなければいいというものではありません。

身勝手な判断が、取り返しのつかない結果を招きます。
「飲酒後は絶対に運転しない」、「制限速度を守る」といった基本的な交通ルールの遵守を、改めて、お願いします。

＜秋の全国交通安全運動について＞

9月21日から「秋の全国交通安全運動」が始まります。

例年、交通事故死者数は、秋から年末にかけて増加する傾向にあり、飲酒運転による重大事故の増加といった特徴もみられます。

飲酒運転をした人はもちろん、飲酒運転しようとする人に車両やお酒を提供した人、飲酒運転の車両に同乗した人も罰則の対象となります。

「飲酒運転を絶対にしない、させない」という「飲酒運転を許さない社会環境」の醸成に取り組んでまいります。
