Foreign Contribution (Regulation) Act (FCRA) is a blessing to those NGO’s who work for the welfare of people & a death-knell for those NGO’s who are acting with an hidden agenda.

It is causing panic attacks for many NGO’s who have been receiving funds from abroad & used it for purposes not stated in their agendas.

Firstly any NGO can receive funds from abroad only at a single SBI Branch which is located in New Delhi. This makes tracking the incoming funds easier. NGO can transfer those funds to other banks where they have accounts but all the donations from abroad should be routed only through the SBI New Delhi Main Branch (NDMB), 11, Sansad Marg, New Delhi.

Mandatory Registration:
All associations receiving foreign funds must either hold an FCRA registration (valid for 5 years) or obtain prior MHA permission.

Strict Activity & State Limits:
NGOs must select specific purposes (e.g., social, religious, educational) and explicitly register for the exact States/Union Territories they operate in. Expanding your scope requires an application (Form FC-6F) and additional fees.

Administrative Cap: Administrative expenses are strictly capped at 20% of the total foreign contribution received in any financial year.

Online Presence:
NGOs must publicly declare their websites, social media accounts, and publications.

Purpose:
NGOs must legally accept foreign funds for specific activities spanning exactly 105 approved purposes. These activities are strictly categorized into five primary domains:
Social
Economic
Educational
Cultural
Religious (Example: should not be strictly used for proselytisation & coercive conversion but can be used to renovate a temple, church or mosque). There are clearly 16 distinct religious practices for which according to the new FCRA rules an NGO is allowed to raise funds. I shall detail them tomorrow.

Several NGO’s are in a state of shock since they never thought that their funds would be tracked & some who are sitting with funds abroad are clueless about how to move them to India.
