Having now reviewed the opinion, this was the logical result, and the surprising outcome would have been the opposite. Federal law directly bars a state from granting residency-based postsecondary benefits to people not lawfully present unless it makes the same benefit available to U.S. citizens regardless of residency. Illinois did not satisfy that condition. Whatever one’s policy view, the Supremacy Clause conclusion was difficult to avoid.
