Subject: A Profound Contradiction That Demands Investigation - The Case of the Bakhtay Khwar Encroachment, Thana.

For the last two weeks, I have been publicly pleading for action against a well-documented illegal encroachment on the main rainy stream in Thana, Malakand. Today, a new letter from the Executive Engineer, dated Oct 31, 2025, has emerged which attempts to provide a justification for inaction.

This letter is not a justification; it is a profound and deeply concerning contradiction of years of established legal precedent and direct action by the Malakand administration itself.

Let's be perfectly clear about the history of this exact spot:

1. The Precedent: Action Taken in 2021
In June 2021, the then-Assistant Commissioner, Sohail Ahmad Khan (PMS), personally led an anti-encroachment operation and demolished illegal constructions at this very same location. This action was not done in secret; it was publicly celebrated on the official Facebook page of the Deputy Commissioner Malakand. His action established an undeniable legal precedent: construction on this waterway is illegal.

2. The Reinforcement: Official Notices in 2024 & 2025
Following this precedent, the Irrigation Department continued to issue notices against new encroachments on this spot, including a final notice for removal on June 19, 2025, declaring the structures "totally illegal" and a violation of the River Protection Ordinance.

3. The U-Turn: The New Letter of Oct 31, 2025
Now, after years of clear enforcement and legal notices, we have a new letter that suddenly claims it is "difficult to specify or demarcate the exact right of way" and that the "clear water way cannot be specified."

This raises serious, unavoidable questions:

* Were the multiple prior notices from the Irrigation Department, declaring the area encroached, just for show?
* Was the 2021 demolition, led by AC Sohail Khan and praised by the DC's own office, a mistake?
* Or has the law suddenly changed for certain powerful individuals who are now involved?

When the law bends so dramatically and official memory becomes so conveniently short, it points to one conclusion: powerful interests are being protected. This new letter is not an administrative clarification; it is a smokescreen designed to give legality to an illegal act. It encourages the encroachment mafia and sends a message that if you are powerful enough, the law does not apply to you.

This isn't just about a building. This is about the main rainy stream for the entire Thana area. Allowing it to be blocked and used as a dumpsite is a guarantee of future flooding and destruction for nearby communities and agricultural lands.

Therefore, I formally request @CSKPOfficial (Chief Secretary Khyber Pakhtunkhwa) to personally intervene and launch an immediate inquiry into this matter. This inquiry must investigate why the Malakand administration and the Irrigation Department have taken a complete U-turn on a settled issue, directly contradicting their own past actions and written records.

The rule of law cannot have two different meanings at the same spot.
