BYPASSING THE RULES: THE DECEPTIVE TRUTH ABOUT H.R. 9237 SECTION 108

Chairman @RepBost offered a manager’s amendment to the Take Care of America’s Veterans Act (H.R. 9237.) Don't be fooled by their latest "compromise."

Originally, Section 108 was written to take effect the very day after it was signed into law. Under pressure from intense veteran backlash, the manager’s amendment shifted the effective date to October 1, 2026.

Moving the date changes absolutely nothing about the substance of the cuts—it just alters the day.

TWO SEPARATE BODIES, ONE MASSIVE END-RUN
Congress and the VA are two entirely separate entities. The VA is the executive agency responsible for clinical rating schedules; Congress is the legislative body meant to pass broad laws.

By including section 108 into H.R. 9237, Congress is stepping out of its lane and hijacking a clinical agency process.

They are executing a separation-of-powers end-run to force a budget cut, explicitly to strip away the six legal administrative safeguards they know the VA cannot legally bypass:

➡️ Analysis of and responses to 2,680+ public comments.
➡️ Revision of the draft final rule and internal VA/legal reviews.
➡️ Inter-agency and OMB/OIRA economic clearance.
➡️ Publication in the Federal Register and Congressional Review Act scrutiny.

Even the VA admits it. VA spokesman Quinn Slaven recently clarified:

“No changes are planned or imminent.”

“VA is still reviewing the proposed rule... VA received significant public comment on the proposal, and it would need to undergo significant changes prior to being finalized.”

THE BOTTOM LINE: Shifting the date to October 1 does not change the fact that Congress is trying to bypass the rules to strip $57B from future veterans. A delayed cut is still a cut.

ACTION NEEDED: Contact your representatives right now. Tell them to oppose any attempt to codify the 2022 VA rating cuts in H.R. 9237 and demand that they strike Section 108 completely from the bill!
