An estimated 2,600 women and girls die from unsafe abortion in Kenya each year—a preventable tragedy often driven by barriers to accessing timely, quality and lawful reproductive healthcare. Protecting access to essential healthcare is not just a public health priority; it is a matter of dignity, equality and the right to health.
Today, the High Court of Kenya delivered its judgment in Petition E490 of 2025, protecting adolescents engaged in consensual, non-coercive and non-exploitative peer sexual relationships from arrests and prosecutions.
The Court:
➡️Directed investigative, prosecutorial and enforcement agencies to distinguish consensual adolescent peer relationships from exploitative or abusive conduct.
➡️Stopped the criminal proceedings against minors charged with defilement for engaging in peer sexual relations.
➡️Ordered relevant agencies in health, education, and child protection to ensure adolescents can access sexual and reproductive health information and services without fear of criminalization.
This is a major win for adolescent rights in Kenya and we continue to advocate for their protection.

A Case Brief on the recent Court of Appeal's ruling (CoA Civil Appeals No. E029 of 2022) on Abortion in Kenya.
The Court of Appeal did overturn the 2022 High Court ruling in PAK & Salim Mohammed v AG. The court held that abortion is only lawful within the narrow limits of Art. 26(4), reinstated criminal charges, and ruled that rights claims (dignity, privacy, health) must be argued during trial not used to stop prosecution early.

Yesterday we had a meeting with the Health Directorate of the Council of Governors, in a session chaired by Director of Health, Ms. Khatra Ali, to introduce the Her Health Kenya Project (HHP)—a five-year systems strengthening initiative focused on advancing equitable access to quality sexual, reproductive and maternal health (SRMH) services for adolescent girls and young women in Kenya.
Developed through a consultative process with @rhnkorg@reprorightsafr@NCPD_Kenya and @MOH_Kenya the project is designed to strengthen national and county systems that shape the health, education, and life outcomes of adolescent girls and young women.
Implementation will focus on Samburu, West Pokot, Garissa, Tana River, and Homa Bay—counties facing a disproportionate burden of teenage pregnancy, HIV infections, low contraceptive uptake, and persistent barriers to accessing quality health services.
