It’s undoubtedly being covered up, and that alone tells you the truth is bad. Why would paddock need 23 guns and thousands of rounds to act alone? And if his goal just to inflict maximum casualties, why would he stop firing and off himself before the police even arrived on his hotel floor?

The question wasn’t if he could do it, it’s if he would do it because he knew it would result in being held in contempt. In his mind, a likely contempt charge was better than telling the truth, even with a pardon. The implication being the truth being exposed was more damaging than him serving some jail time.

Under the Supreme Court’s decision in Brown v. Walker (1896), once a person has received (and accepted) a pardon, they “cannot longer set up [the] privilege, since [they stand], with respect to such offense, as if it had never been committed.” There is no longer a realistic threat of federal prosecution for the pardoned conduct, so the privilege does not apply to questions about it.

@JamesDe10461965 @carl_allen_87 @jackunheard As Rand Paul said after the hearing, they can and likely will challenge the validity of the pardons in court at some point. There’s a real argument for why they aren’t valid, there’s just no precedent so the legal outcome is highly uncertain.

He’s stuck between a rock and a hard place ahead of tomorrow’s testimony. Either he sticks to the same false statements and perjures himself, or his statements contradict his prior testimony and he still perjures himself (changing the story to be true can be used as evidence that his prior statements were knowingly false)
