The case of President Cyril Ramaphosa appointing someone outside of Cabinet in an Acting role with no due consideration of the Constitutional Provisions, and everyone assuming that they surely considered it, is textbook appeal to authority fallacy.

Section 91 (3)(c) of the Constitution of South Africa empowers the President to select no more than two Ministers from outside the National Assembly

However, Section 98 of the Constitution of South Africa says “The President may assign to a Minister any power or function of another Minister who is absent or otherwise unable to fulfil the functions of office.”

Section 91 (3)(c) makes no provision for the appointment of an Acting Minister, which is what Ramaphosa has done. Section 98 is clear on the delegation of powers and functions of a Minister who is unable to fulfil their functions to another Minister.

In this instance, Senzo Mchunu is unable to fulfil his duties and functions due to special leave and a Commission of Inquiry.

Cachalia is not a Minister and therefore cannot be assigned duties of another Minister who is unable to fulfil their duties.

Cachalia has not been appointed as a Minister of any department to whom functions of other Ministries can be assigned, he has been appointed in an Acting capacity, using a clause in the Constitution that makes no provision for the role of Acting.

For this to be Constitutionally sound, Cachalia must be appointed in terms of Section 91 (3)(c) to a Ministry of his own, and subsequently assigned the functions and duties of the Police Ministry. Anything other than this is unconstitutional.

Political analysts and even some in the opposition assume that the Presidency is making a lawful decision by virtue of it being an authority. Therefore no one thinks to consider legality.

This is dangerous.
