Supreme Court of India has heard two very similar cases back to back

Sexual abuse allegations of child levelled against the father in matrimonial and child custody dispute

In both cases POCSO case was filed after father got visitation or custody rights

In one judgment, the Judge used POCSO allegations to deprive a father completely of any contact with his children and allowed the mother to take the kids to another country practically removing the father from life of his children forever

In other judgment, the Judge looked at entire facts of the case, the games that were played, the clear abuse of law and has now passed guidelines on misuse of POCSO allegations in child custody disputes and also upheld that the custody of child should be with the father who was falsely accused in POCSO case

JUSTICE IS INDIA IS NOT REALLY LAW CENTRIC BUT JUDGE CENTRIC

Nth time I have come to this realisation!
