The answer isn’t complicated. More regulations won’t solve the challenges facing the endangered North Atlantic right whale.

Fishing has been part of the fabric of our seafaring nation for centuries. Yet increasingly burdensome regulations are driving hardworking fishing families out of business, while failing to stop right whale deaths.

At the same time, industrial offshore wind development along the Outer Continental Shelf has coincided with an increase in “unusual mortality events” involving several cetacean species.

It’s unusual, but not surprising.

Highly intelligent whales have evolved to avoid ship strikes and fishing gear. They also adjust their feeding and breeding patterns in response to changing prey availability and environmental conditions. Just as people relocate in search of a better quality of life, whales and dolphins shift their ranges as conditions change. As NOAA Fisheries acknowledged in 2021, “Construction and operation of hundreds of wind turbines is likely to introduce increased ocean noise, vessel traffic, and possibly habitat alteration. All of these factors have the potential to affect right whales.”

Unfortunately, offshore wind leases and permits have relied on cetacean distribution models that can be years out of date by the time construction begins. Models developed by Duke University are widely regarded as a leading standard for predicting cetacean distribution, yet the data used for leasing and permitting may be nearly a decade old when projects are finally built. As one NOAA marine biologist told us, “The models are obsolete by the time offshore wind construction begins.”
