The Fourth Amendment exists for exactly this scenario: the government cannot search your person, papers, or effects without probable cause and a warrant. Here's what's actually been built that bypasses that protection at scale — and it doesn't care what you voted.
**Cellebrite**, an Israeli firm, has held over 213 ICE contracts since 2008 worth $48.6 million-plus, for devices that bypass smartphone locks and extract everything on a phone — geolocation history, bank records, texts, photos — without a warrant. ICE's Dallas office alone sought up to $35 million more, enough for thousands of additional units.
**Paragon Solutions**, another Israeli spyware maker, holds an ICE contract for "Graphite" spyware capable of hacking any phone, including encrypted apps — reactivated by this administration after a prior compliance freeze over security concerns. CitizenLab has documented that same spyware used against journalists and political activists abroad.
**Mobile Fortify**, used over 100,000 times since June 2025, scans faces against a database of more than 200 million images pulled from DHS, FBI, and State Department records — no warrant required, no probable cause needed. 404 Media obtained footage of officers using it to check teenagers' citizenship simply for not carrying ID.
**Flock Safety** license plate readers operate in every state but Alaska; 404 Media documented over 4,000 instances of local police pulling Flock data on ICE's behalf, and researchers found agencies in Washington state letting Border Patrol search their networks directly — in violation of a state law specifically written to prevent it.
And when Congress asked directly whether any of this amounts to a citizen-tracking database, DHS leadership told them no — under oath — after video surfaced of an ICE officer saying he'd add someone to a "nice little database" as a "domestic terrorist." That gap between sworn testimony and documented infrastructure is now the subject of formal congressional inquiry.
Here's why this isn't partisan.
A warrantless search doesn't ask your party registration before it happens. The Fourth Amendment doesn't have a carve-out for immigration enforcement, and legal advocates on the right and left have said so — this same surveillance web sweeps in U.S. citizens' cell data, citizen children's addresses through Medicaid records tied to parents, journalists tracked through sources, and protesters logged at demonstrations. Infrastructure built for one purpose today gets used for whatever purpose tomorrow's administration decides — of either party.
Call your senators and representatives. Ask them directly:
1. Will you support legislation requiring a warrant before phone extraction, facial recognition search, or license plate tracking data can be used against a U.S. citizen?
2. Will you demand DHS answer, under oath and specifically, the discrepancy between its sworn congressional testimony denying a citizen database and its documented Palantir, Cellebrite, and Flock infrastructure?
3. Will you support state-level laws — like Washington's Keep Washington Working Act — that bar local police from sharing surveillance data with federal immigration enforcement without a warrant, and will you support their enforcement?
This is a constitutional question, not a culture-war one. Defend it like it is.
