Mozambican Lawyer Daniel Tembe Analyzes Detention of Turkish National Emre Çınar on MBC TV
In an interview with MBC TV Mozambique, attorney Daniel Tembe presented a legal assessment concerning the detention of Emre Çınar, the Turkish legal representative of Willow International School in Mozambique. His analysis raises significant legal and human rights questions about the case.
Lawyer Daniel Tembe: ''In my understanding, the detention of the person is illegal due to the absence of a protocol, that is, of a treaty, an extradition treaty between these countries. This issue, this absence, raises several debates. This is what has been happening in various media outlets regarding its legality or not.
Particularly, I will give you my point of view on this. I believe that this detention is not legal. First, we have here a violation of a constant principle of law, which is the right to be before one's lawyer during the hearing.
I base my position on the fact that Mozambique is a signatory to the Universal Declaration of Human Rights. Mozambique cannot accept extraditing this citizen to his country of origin. Why? Because Mozambique is a signatory to the Universal Declaration of Human Rights. Therefore, it cannot, should not, and should not accept this citizen being extradited.
In context, the citizen in question cannot suffer reprisals, as is happening. This person cannot suffer reprisals. And what we are understanding is that there is a political persecution. There is political persecution and it is for this reason that this individual is being detained.
Therefore, being detained exactly because of this, we suspect, we are not sure, exactly because of this issue of political persecution, he should not be extradited. His extradition would be illegal, would be contrary to the law.
I raise the hypothesis of political persecution, linking the case to previous requests dating back to the term of the previous government.''
PUBLIC HUMAN RIGHTS UPDATE: This update reflects the current situation of Turkish Lawyer Emre ÇINAR as of 1 January 2026.
URA recalls Amnesty Southern Africa’s @AmnestySARO public call that the authorities must grant Mr. Emre ÇINAR confidential access to his lawyer and family and that no individual should be transferred to a country where they face a real risk of serious human rights violations, including unlawful or arbitrary detention.
According to the latest information received, Mr. Çınar’s family and legal representatives, since his detention on 30 December 2025 at approximately 15:00, neither his family nor his lawyers have been granted face-to-face or confidential access to him.
As of today, no direct in-person access to legal counsel has been permitted.
Furthermore, based on the same information, the family and legal representatives have not been formally informed whether:
Mr. Çınar has appeared before a judge; any judicial decision authorising his detention, arrest, or extradition has been issued; the legal and factual grounds of the alleged extradition request have been disclosed.
While investigative proceedings may involve a degree of confidentiality, the legal basis of detention and the right of confidential access to a lawyer and family cannot lawfully remain undisclosed or restricted.
In the absence of these safeguards, the right to defence is effectively undermined, and the risk of arbitrary or incommunicado detention is heightened.
On 31 December 2025, Mozambique’s National Criminal Investigation Service (SERNIC) publicly confirmed that Mr. Emre Çınar, a Turkish national, has been in custody since 30 December 2025, allegedly in connection with an extradition request from the Republic of Türkiye, and that he is expected to be brought before a criminal investigation judge. However, serious and ongoing due process concerns persist.
The Universal Rights Association therefore respectfully calls upon the Mozambican authorities to ensure:
immediate, confidential, and unhindered access to legal counsel and family members for Mr. Çınar;
formal disclosure of any judicial decisions concerning his detention or any extradition proceedings; and
strict compliance with the principle of non-refoulement and with due process guarantees under Mozambique’s Constitution and applicable international human rights law, including the prohibition of arbitrary and incommunicado detention.
Until these safeguards are clearly and verifiably implemented, URA remains seriously concerned about the risk of arbitrary detention, unlawful transfer, and the denial of fundamental procedural rights.

🚨 URGENT
We hear that a plane from Turkey has landed in Mozambique.
If Emre Çınar is taken without a clear court process, this is abduction, not justice.
International law is clear:
• ICCPR Article 9 – no arbitrary or secret detention
• ICCPR Article 7 – no torture or ill-treatment
• Convention Against Torture Article 3 – no sending anyone to a place where they risk torture
Mozambique must not become part of this abuse.
Those involved will carry international responsibility.
Dear President @daniel_chapo24
Please uphold your country’s sovereignty and ensure a fair process for Emre Cinar. Detaining and extraditing persons without fair access to justice upon demands by foreign governments whose actions are known to disregard international and humanitarian laws is a big blow to African spirit and sovereignty.
@URASAFRICA@_AfricanUnion
A Turkish lawyer in lawful exile, Emre Çınar, was detained in Mozambique under an extradition request from Turkey. This raises grave concerns of transnational repression and risk of unlawful extradition to a country where fair trial guarantees no longer exist.

Mozambik’de Kayıp Türk Bulundu
🇲🇿 Mozambik’te kayıp Türk vatandaşı Emre Çınar’a ulaşıldı.
Mozambik Adalet Bakanlığı, Türkiye’nin iade talebi üzerine gözaltına işleminin olduğunu, kamuoyu tepkisi sebebiyle bundan vazgeçildiğini açıkladı.
Bakanlık, hukuk dışı herhangi bir işlem yapılmayacağını belirterek Emre Çınar’ın tutulduğu yeri yakınlarıyla paylaştı.
🚨 URGENT: FEARS OF ENFORCED DISAPPEARANCE IN MOZAMBIQUE
A Turkish lawyer Emre Çınar (35), who has lived in exile in Maputo since 2017, was detained on 30 Dec 2025 (~15:00) by officials believed to be Mozambican intelligence.
His whereabouts remain unknown, raising serious risk of enforced disappearance & unlawful extradition.
According to information provided by his family and local Mozambican reports, his phone and personal belongings were confiscated, and he was told that he would be taken to the public prosecutor’s office. However, the alarming reality:
❌ He has NOT appeared before a prosecutor.
❌ He is NOT registered at any police station.
❌ There is NO official record of his detention.
❌ His whereabouts are currently UNKNOWN.
No official explanation has been provided to his lawyers or family.
Emre has lived lawfully in Mozambique since 2017 after fleeing political pressure in Türkiye. There are grave concerns of an illegal "black site" detention or imminent unlawful extradition (refoulement) linked to Turkish political requests.
As a result of ongoing inquiries, grave concerns have emerged that this incident may be linked to politically motivated extradition requests by the Turkish authorities.
It is widely known within the international community that Türkiye has, for many years, pursued the return of individuals abroad for political reasons.

📣For this reasons, we call upon:
• The United Nations (UN)
• The UN Working Group on Arbitrary Detention
• The UN Working Group on Enforced or Involuntary Disappearances
• Amnesty International
• Human Rights Watch
• The African Commission on Human and Peoples’ Rights as well as all international human rights institutions, lawyers, journalists, and people of conscience, to urgently raise their voices.
⚠️ Any secret detention or extradition that violates the rule of law, human rights, and international conventions is unacceptable.
We demand that:
• Emre Çınar’s whereabouts be immediately disclosed,
• He be granted access to his lawyers,
• His legal and procedural safeguards be fully ensured.
Silence is the greatest enabler of such violations.

#INJUSTICEALERT: Emerging pattern of covert detentions of Turkish nationals abroad. On Dec 30, 2025, Emre Ginar was seized in Maputo by individuals claiming to be Mozambican intelligence officers. The detention mirrors the recent case of Mustafa Gungor in Kenya. We join others to urge the Mozambican authorities to urgently ascertain and disclose his location and call on regional and international human rights bodies to monitor and demand accountability. #StopTransnationalRepression #Turkiye

Update on the Detention of Emre Çınar in Mozambique
Mozambique’s National Criminal Investigation Service (SERNIC) has officially confirmed the detention of Turkish national Emre Çınar on December 30, 2025, pursuant to an extradition process initiated by Mozambican judicial authorities at the request of the Republic of Türkiye.
SERNIC states that the detention was carried out in full observance of legal formalities and rejects allegations of abduction or arbitrary deprivation of liberty circulated in some media and communication channels.
However, given the gravity of extradition-related detention, the authorities should reaffirm—and demonstrate in practice—their commitment to human rights, due process, and institutional transparency, including guarantees of meaningful judicial oversight and protection against any irregular or expedited transfer.
We urge international human rights organizations, diplomatic missions, and independent legal observers to closely monitor the proceedings, with particular attention to immediate access to counsel, fair trial protections, and safeguards against any unlawful or forcible transfer.

🚨 URGENT ACTION: FEAR OF REFOULEMENT IN KENYA
Amnesty International is deeply concerned that Mustafa Güngör who was arrested with his wife Zeliha, daughters Seniha Betül and Zeynep, and his in-laws Zümrüt and Salim is at serious risk of refoulement to Türkiye, where he could be subjected to arbitrary detention, torture, or ill-treatment. We have reliably learnt the Turkiye authorities sought his arrest through a Mutual Legal Assistance request to office of the Attorney General. Kenya has an obligation under international law not to return anyone to a country where they face persecution or harm. We call on the @DCI_Kenya and both authorities to: ✅ Respect the legal principle of non-refoulement ✅ Ensure due process and protection for family ✅ Allow continued access to legal representation and UNHCR and @Kenyajudiciary
Our officers are currently at the DCI Upper Hill with family lawyers. #StopRefoulement #HumanRights #Kenya #Türkiye

ACİL DURUM: EDİRNE'DE TUTUKLU HAMİLE KADINLARA EZİYET
Edirne L Tipi Cezaevi'nde şu anda iki hamile var. Nazife Karakoç 8, Leyla Arslan 7 aylık hamile. Bugünkü (18 Aralık) görüşte insanlık dışı muamelelere maruz kaldıklarını anlattılar. 8 aylık hamile mecburen her hafta doktor kontrolüne götürülüyor.
