I am a big believer in Tesla and its FSD program but the truth is there are still significant challenges that Tesla faces and an uphill regulatory battle that cannot be ignored. I have to believe that the Tesla team is aware of ALL the regulatory and safety challenges they face. But as of today they have done nothing but project confidence, which implies that they (somehow) see a path forward. Regulators will face a lot of scrutiny approving Tesla autonomous vehicles program in it’s current form factor, considering their very different approach to autonomy. The last thing that regulators, who are responsible for safety, want is to approve a platform that could potentially result in any harm. The legislators can easily pass additional regulation that includes requirements that Tesla will have a hard time meeting. Examples: 3 years of supervised testing by approved testers, requirement for alternative sensors (LiDAR, Radar, etc.), a disengagement rate far in excess of what Tesla can currently achieve, etc.
Even if Tesla is somehow able to overcome the regulatory hurdles they face, one of the big issues I see is the inevitable weaponization of the media against their Robotaxi program. Car accidents happen all the time and it is basically guaranteed that as Tesla scales, their Robotaxis will be involved in collisions, some of which will result in bodily harm or death; that is simply a reality. The only question that should matter is: are they safer than regular vehicles with human drivers? Are they getting into more or less accidents per million miles driven autonomously? Of course, that will not be the focus of the media companies nor your everyday politicians. I can already see the headlines (“Tesla Robotaxi Strikes Pedestrian”, “Tesla Robotaxi, the Cause of a Multi-Car Collision on Interstate 9”, “Investigation Opened on Tesla Robotaxis after Multiple Vehicular Accidents Reported” , “Here is the Family of 5 that was Killed by Elon Musk’s Robotaxi and FSD Software”, etc.).
Ultimately, your average person who’s never experienced FSD before will be afraid to try it. There will be so much fear mongering out there amplified by the news that even regulators, politicians, potential customers, will be afraid and act out of that fear. Tesla needs to work hard to rebuild their brand image, restore trust (that will constantly be put to the test), and control the narrative regarding Tesla own interest in safety over expedience. Tesla’s are some of the safest vehicles on the road. They need to remind customers and non-customers alike of the extraordinary efforts they have gone through to enhance the safety of all there vehicles, far in excess of other manufacturers. In my mind, that level of interest in safety can be extrapolated to their handling of all other aspects of what they do, including their Robotaxi program and FSD software. There is still a lot of work ahead for Tesla but I truly believe it is only a matter of time before their software will be responsible for the saving of countless lives.
