The Government of Brazil (AGU) cannot have it both ways when trying to defend Alexandre de Moraes.
When addressing the U.S. Department of Justice, the Government of Brazil said its court orders “operate strictly within” Brazil, have no extraterritorial effect, and must be served through the MLAT or Hague Convention.
But in U.S. court, Brazil now asks for dismissal of the case against Moraes on the theory that a Brazilian judge’s orders emailed into Florida, demanding censorship of U.S. platforms and users, are Brazilian sovereign acts that cannot be reviewed by U.S. courts.
This is not about whether Moraes may apply Brazilian law in Brazil. This is about whether a foreign judge can bypass reach into the United States by email and impose censorship, data, and payment restrictions on U.S. companies on U.S. law.
The answer is no. Respect for sovereignty cuts both ways. Brazil’s sovereignty does not include authority to enforce judicial orders on American soil to censor speech by American citizens without consent or knowledge of U.S. authorities.
