Justice or Political Persecution? How the El-Rufai Trial Is Testing Nigeria’s Democracy

If Mallam Nasir El-Rufai committed any act of corruption during his tenure as Governor of Kaduna State, then let the evidence be presented before a competent court. Let witnesses testify. Let the law take its full course. If he is found guilty, let justice prevail. That is what every Nigerian expects from a constitutional democracy.

But that is not what many Nigerians believe they are witnessing today.

A court approved Mallam El-Rufai’s medical consultation. He was taken to see his doctor. Yet, instead of reassuring the public that due process was being followed, the nation woke up to reports that his personal physician had been arrested over events surrounding that medical visit. Nigerians are left asking a simple question: Is the focus still on prosecuting the allegations before the court, or has the process itself become the punishment?

This is a dangerous path for any democracy. When a citizen is subjected to increasingly restrictive measures, denied practical access to bail, and every procedural step becomes another public spectacle, confidence in our institutions inevitably suffers. Anti-corruption agencies earn public trust by proving cases with evidence in court, not by creating the impression that humiliation has become part of the prosecution strategy.

The ICPC must remember that its credibility rests not only on fighting corruption but on doing so with fairness, professionalism, and strict adherence to the rule of law. Every action that appears excessive or inconsistent raises legitimate questions in the minds of Nigerians. Institutions are strongest when they are seen as impartial, not when they are perceived as actors in political contests.

President Bola Ahmed Tinubu’s administration must also appreciate that opposition politics is not a criminal offence. Democracy thrives because citizens have the freedom to disagree, to organise, and to challenge those in power. Criminal allegations should be determined in court through credible evidence, not through prolonged processes that many citizens perceive as punitive before any verdict has been reached.

This case has become bigger than Mallam Nasir El-Rufai. It is now a test of Nigeria’s commitment to constitutionalism, due process, and equal justice under the law. If our institutions fail this test, the damage will not end with one man or one political party. It will weaken public confidence in the very foundations of our democracy.

Today, it is Mallam Nasir El-Rufai.

Tomorrow, it could be any Nigerian who dares to stand on the other side of power.

The El-Rufai Support Group Association (ERSGA) has announced the engagement of Washington-based advocacy organisation Vanguard Africa to lead a campaign aimed at drawing international attention to what it describes as growing concerns over due process and the rule of law in Nigeria.
