இம்மனுக்கள் மூத்த வழக்கறிஞர் பி. வில்சன் அவர்களால் வரைவு செய்யப்பட்டு இறுதி செய்யப்பட்டுள்ளது.

திராவிட முன்னேற்றக் கழகம் (திமுக), அதன் விவசாயிகள் அணி செயலாளர் திரு. A.K.S விஜயன்அவர்கள் மூலம், சிவில் மேல்முறையீட்டு வழக்கு எண்2453/2007-ல் இடைக்கால மனுவைத் தாக்கல் செய்து, தமிழ்நாட்டிற்கு காவிரி நீரை உடனடியாக திறந்துவிடஅவசர உத்தரவு பிறப்பிக்கவும், 16.02.2018 அன்று உச்சநீதிமன்றம் வழங்கிய தீர்ப்பைநடைமுறைப்படுத்தவும், காவிரி நீர் ஒழுங்குமுறை குழு(CWRC) மற்றும் காவிரி நீர் மேலாண்மை ஆணையம் (CWMA) வழங்கிய உத்தரவுகளை அமல்படுத்தவும் மாண்புமிகு உச்சநீதிமன்றத்தை அணுகியுள்ளது.

இந்த மனுவில் மாண்புமிகு உச்சநீதிமன்றத்திடம் பின்வரும் நிவாரணங்கள் கோரப்பட்டுள்ளன:

I. 28.07.2026 அன்று காவிரி நீர் ஒழுங்குமுறை குழு(CWRC) வழங்கியதும், 30.07.2026 அன்று காவிரிநீர் மேலாண்மை ஆணையம் (CWMA) உறுதி செய்ததுமான உத்தரவை கர்நாடக அரசுஉடனடியாக முழுமையாக செயல்படுத்துமாறு உத்தரவிட வேண்டும்.

அதன்படி, மாண்புமிகு உச்சநீதிமன்றத்தின் உத்தரவு பிறப்பிக்கப்பட்ட நாளிலிருந்து தொடர்ந்து 15 நாட்களுக்கு தினமும்3,500 கனஅடி (கியூசெக்ஸ்) தண்ணீர்பிலிகுண்டுலுவில் திறந்துவிடவும், 29.07.2026 முதல்ஏற்பட்டுள்ள பற்றாக்குறையையும் ஈடு செய்யுமாறு உத்தரவிட வேண்டும்.

II. 26.07.2026 நிலவரப்படி, விகிதாச்சார (Distress Sharing) அடிப்படையில் தமிழ்நாட்டிற்கு வழங்கப்பட வேண்டிய 9.46 டி.எம்.சி. நீர்பற்றாக்குறையை ஈடு செய்யும் வகையில், 15 நாட்களுக்கு தினமும் சுமார் 7,000 கியூசெக்ஸ் தண்ணீர் பிலிகுண்டுலுவில் கிடைக்குமாறு கர்நாடக அரசுக்கு உத்தரவிட வேண்டும்.

III. கர்நாடக அணைகளிலிருந்து திறக்கப்படும் நீரையும், பிலிகுண்டுலுவில் கிடைக்கும் நீரின் அளவையும் காவிரி நீர் மேலாண்மை ஆணையம்(CWMA) தினசரி கண்காணித்து, அதன் அமலாக்கநிலையை மாண்புமிகு உச்சநீதிமன்றத்தில் அறிக்கையாக தாக்கல் செய்யுமாறு உத்தரவிடவேண்டும்.

IV. வழக்கின் உண்மை நிலைகள் மற்றும் சூழ்நிலைகளைக் கருத்தில் கொண்டு, நீதியை நிலைநாட்டுவதற்குத் தேவையான பிற உரிய உத்தரவுகளையும் மாண்புமிகு உச்சநீதிமன்றம் பிறப்பிக்க வேண்டும்.

கர்நாடக அரசு, காவிரி நீர் மேலாண்மை திட்டத்தின்கீழ் அமைக்கப்பட்டுள்ள சட்டப்பூர்வ அமைப்புகளின்கட்டாய உத்தரவுகளைப் பின்பற்றாமல் காவிரி நீரைதிறந்துவிட மறுத்துள்ளதால், காவிரி டெல்டாபகுதியைச் சேர்ந்த இலட்சக்கணக்கான விவசாயிகள் கடுமையாக பாதிக்கப்பட்டுள்ளனர் என்பதை இந்த மனுசுட்டிக்காட்டுகிறது. விவசாயிகளின் வாழ்வாதாரத்தைப் பாதுகாக்கவும், உச்சநீதிமன்றத்தின் 16.02.2018 தீர்ப்பை முழுமையாக அமல்படுத்தவும், உடனடிதலையீடு செய்யுமாறு மாண்புமிகு உச்சநீதிமன்றத்திடம் இம்மனு கோருகிறது.

மேற்கூறிய மேல்முறையீட்டில் திராவிட முன்னேற்ற கழகத்தையும் , காவிரி நீர் மேலாண்மை ஆணையத்தையும் (CWMA) ஒரு தரப்பினராக இணைத்துக்கொள்ளுமாறும் திமுக கோரியுள்ளது.
