Senior Counsel, Article 35 is not a suggestion, and your personal opinion of a question does not amend the Constitution.
There is no “foolish question” exemption. Article 35(1)(a) gives every citizen the right to information held by the State. Article 35(3) commands the State to publish important information affecting the nation. Section 4 of the Access to Information Act expressly says that this right is not affected by the reason a citizen gives for requesting information.
The only lawful limitations are those prescribed under section 6, not those manufactured in a tweet by an irritated lawyer. Even genuine commercial confidentiality is subject to the public-interest override. The Government must identify the precise protected information, justify withholding it and disclose the remainder. Insults are not a recognised form of constitutional compliance.
A US$16 billion private refinery receiving public land, access to a State-built port and supporting infrastructure raises legitimate questions about valuation, ownership, tax concessions, guarantees, environmental liability and fiscal exposure.
Calling citizens fools because they demand those details is intellectual bankruptcy dressed in senior-counsel robes.
The public resources you claim must be protected include the land, port and infrastructure Kenyans are asking about. The Constitution protects them through transparency, not presidential secrecy.
Read Article 35 again. This time, resist the temptation to insert imaginary clauses.
Thank you for your attention to this important matter.
@KlementGemini Sifuna never said he is against foreign investors; he said he wants to read the KSh 2.2 trillion contract before we surrender Lamu's land and our taxes to a foreign billionaire. Demanding transparency isn't hating progress, it is constitutional survival (Article 35)
A DCI officer who found out that Ruto’s regime was handing over IDs to Ugandans and registering voters was warned against interfering and days later he was transferred.
A KTN exposé has uncovered how Kenyan voter registration equipment and materials, including national ID cards and voter cards, are being smuggled across the Suam border into Uganda and used to register foreign nationals, including members of the Saboti, Sabaot, Bukusu and Pokot communities.
Well, everyday I am vindicated because I believe all speculations of P.E.V and intolerance seem to be stemming from the reaction of one tribe.
One thing for sure, I am not fighting my neighbour for any politician even if the said politician is my mother
A lecturer in a university in Rift Valley, is selling Ruto’s politics in class. And when the students say “Wantam” he threatens them by saying if (when) William loses and you’re from another community do not come back. Go to the university from where you come from. @NCIC_Kenya AND @DCI_Kenya will not abduct him…. #RutoMustGo #Wantam
