Appeal is a statutory right and an essential facet of access to justice.
The judiciary has often gone to extraordinary lengths to ensure that justice is not denied on technical grounds.
If portal-related constraints hinder the filing of appeals, the issue warrants urgent attention.
Technology must facilitate, not impede, the administration of justice.

The GSTAT portal is facing serious technical issues:
❌ Login & OTP failures
❌ Appeal filing errors
❌ Document upload issues
❌ Frequent session expiry & portal crashes
Taxpayers and professionals cannot be deprived of their statutory right to appeal due to system failures.
@FinMinIndia@cbic_india must immediately extend the GSTAT appeal filing due date until the portal is fully stable.
Justice cannot depend on a faulty portal.

Till date, I have not received any satisfactory answer as to why Balance Sheet figures are being asked for when no books of accounts are maintained.
Perhaps what the ITD intends is not to require full financial statements to be entered in the ITR form, but instead to mandate that all taxpayers maintain books of accounts so that such particulars can be furnished.
Otherwise, how can Balance Sheet figures be reported in the ITR form where books of accounts are not maintained?
How is that logical? Need opinions of all 🙏🏻
🚨ITR Extension by Punjab & Haryana High court
This is What Exactly Happened 👇👇👇
The Honourable Punjab and Haryana High court scolded the council of CBDT for non compliance of extension order by Honourable Gujarat Court*
They even said the council that if the date is not extended till now it's a clear contempt of High Court orders.
The CBDT council tried to borrow more time by seeking next date by saying the matter is pending with CBDT Chairman now..
*The Honourable Court adjourned the matter till tomm i.e 29/10/2025 and asked the council to get the extension order*

जब Gujarat High Court ने यह स्पष्ट कर दिया है कि जब Tax Audit Report की तारीख़ 30 सितम्बर से बढ़ाकर 31 अक्टूबर कर दी गई है, तो Income Tax Return की due date भी स्वाभाविक रूप से एक माह बाद अर्थात् 30 नवम्बर 2025 तक बढ़ाई जानी चाहिए, तब यह प्रश्न और भी गहरा हो जाता है कि CBDT ने अभी तक ऐसा क्यों नहीं किया?
Income Tax Act की धाराएँ 44AB और 139(1) स्पष्ट रूप से यह दर्शाती हैं कि Audit Report और ITR Filing का chronological इफेक्ट है - पहले Audit, फिर Return। ऐसे में अगर Audit की तारीख़ बढ़ाई गई है तो Return की due date भी logically और legally एक माह आगे बढ़नी चाहिए।
Court ने माना कि यह non extension न केवल अनुचित है बल्कि taxpayers और professionals पर अनावश्यक दबाव डालती है।
अब जब High Court ने स्वयं यह principle स्थापित किया है कि “1 month extension” दिया जाना चाहिए, तो अगर CBDT इसके बावजूद कोई कदम नहीं उठाता, तो यह प्रश्न उठना स्वाभाविक है कि क्या यह न्यायालय की भावना की अवहेलना या कहें तो contempt of court की श्रेणी में नहीं आता?
Audit Reports भले ही लगभग पूरी हो रही हों, पर Diwali season, staff shortage, और compliance pressure के बीच लाखों assessees के लिए ITR Filing practically संभव नहीं है।
इसलिए यह अपेक्षा स्वाभाविक है कि CBDT कानून की मंशा और न्यायालय के आदेश का सम्मान करते हुए due date को 30 नवम्बर 2025 तक बढ़ाए ताकि professionals और taxpayers दोनों शांति और संतुलन के साथ काम कर सकें, और compliance की गुणवत्ता भी बनी रहे।
