वरली ‘आईएनएस त्राटा’ (#INSTrata) प्रकरण : सुराज्य अभियान की राष्ट्रपति से शिकायत के बाद केंद्र सरकार एक्शन मोड में !

वर्ष 2025 में ही दी थी चेतावनी; अब तो कठोर सुरक्षा नियमावली लागू करें – सुराज्य अभियान

यह मामला न्यायालय में जाने से पहले ही @SurajyaAbhiyan के महाराष्ट्र राज्य समन्वयक श्री अभिषेक मुरुकटे ने 25 मई 2025 और 20 फरवरी 2026 को प्रधानमंत्री कार्यालय, गृह मंत्रालय तथा रक्षा मंत्रालय को ई-मेल के माध्यम से शिकायत की थी। इसके बाद 23 अगस्त 2026 को उन्होंने भारत की माननीय राष्ट्रपति को विस्तृत ज्ञापन भेजकर निम्नलिखित प्रमुख मांगें की थीं :

1. ऊंचाई पर कड़ी सीमाएं (Mandatory Height Caps) : संवेदनशील सैन्य प्रतिष्ठानों तथा तटीय रक्षा क्षेत्रों के 1 से 2 किलोमीटर के दायरे में नई इमारतों की ऊंचाई पर कड़ी सीमाएं निर्धारित की जाएं।

2. रक्षा मंत्रालय की अनापत्ति अनिवार्य (Defence NOC) : नगर नियोजन प्राधिकरणों द्वारा किसी भी निर्माण को मंजूरी देने से पहले रक्षा मंत्रालय तथा नौसेना से ‘अनापत्ति प्रमाणपत्र’ (NOC) लेना कानूनी रूप से अनिवार्य किया जाए।

3. वर्ष 2011 के परिपत्र का क्रियान्वयन : सैन्य प्रतिष्ठानों की सुरक्षा के लिए 18 मई 2011 को रक्षा मंत्रालय द्वारा जारी नियमावली का सभी प्राधिकरणों द्वारा कड़ाई से पालन किया जाए।

सुराज्य अभियान द्वारा लगातार किए गए इस प्रयास के बाद अब केंद्र सरकार ने मुंबई उच्च न्यायालय का रुख किया है। मुख्य न्यायाधीश महेश चंद्र त्रिपाठी तथा न्यायमूर्ति अद्वैत एम. सेठना की खंडपीठ के समक्ष केंद्र सरकार की ओर से वरिष्ठ अधिवक्ता ए. एस. खांडेपारकर ने नौसेना की सुरक्षा से संबंधित पक्ष रखा।

इस पर उच्च न्यायालय ने राज्य सरकार, बीएमसी तथा म्हाडा को नोटिस जारी करते हुए 2 सप्ताह के भीतर जवाब दाखिल करने के निर्देश दिए हैं। साथ ही, न्यायालय ने स्पष्ट किया है कि ‘याचिका पर होने वाले अंतिम निर्णय के अधीन ही आगे का निर्माण कार्य होगा।’ इसके अतिरिक्त, सर्वोच्च न्यायालय ने भी ‘टेक्नो फ्रेशवर्ल्ड’ मामले में म्हाडा को 18 मई 2011 के परिपत्र के संबंध में स्पष्टीकरण देने के निर्देश दिए हैं।

इस प्रकरण पर बोलते हुए श्री अभिषेक मुरुकटे ने कहा, “इमारत की ऊंचाई अचानक ढाई गुना बढ़ाते समय क्या सुरक्षा नियमों को ताक पर रख दिया गया था, यह हमारा मुख्य प्रश्न था। हमारे ज्ञापनों के बाद केंद्र सरकार द्वारा न्यायालय में कदम उठाना और न्यायालय द्वारा नोटिस जारी करना, जनहित में हमारे निरंतर प्रयासों का परिणाम है। सुराज्य अभियान की मांग है कि इन विवादास्पद निर्माण अनुमतियों की उच्चस्तरीय जांच की जाए तथा देशभर में सभी सैन्य प्रतिष्ठानों के निकट होने वाले निर्माण कार्यों के लिए एकसमान और कठोर सुरक्षा नियमावली लागू की जाए।”

3. Strict Implementation of the 2011 Circular: Ensure rigid compliance by all planning authorities with the Ministry of Defence circular dated May 18, 2011, regarding military security.

We @surajyaabhiyan had raised this issue in 2025 — Now The Union government has approached the Bombay High Court against the reconstruction of a building being undertaken right next to a crucial defence unit under the Western Naval Command.
