HRCP releases detailed analysis of proposed Punjab Labour Code 2025

In this edition of its Legislation Watch Cell series, HRCP observes that the Punjab Labour Code (PLC) 2025, currently under consideration by a provincial assembly standing committee, seeks to consolidate existing labour laws but—according to many trade unions and labour right activists—without adequately protecting workers’ rights. This could risk rolling back hard-won safeguards.

Authored by lawyer @azwarshakeel12 and academic Dr Adnan Sattar, the report cautions that the PLC, if enacted in its current form, could further weaken unionization and collective bargaining by placing onerous restrictions on registration and strikes. It raises concerns about the PLC’s compliance with @ilo conventions, including those pertaining to freedom of association, protection from forced and child labour, and the right to equality at work. The authors trace this primarily to inadequate meaningful consultation with workers and trade unions, despite ILO requirements for tripartite dialogue in labour law reform.

Among its key recommendations, HRCP calls for removing barriers to union registration and collective bargaining to enable genuine worker representation; explicit safeguards against discrimination and unfair dismissal, including protections for contract and informal workers; clear mechanisms for workplace safety and inspections, with stronger penalties for violations; and inclusive, tripartite consultations to ensure workers’ voices are part of lawmaking.
