The Baloch Yakjehti Committee strongly condemns the conduct of the jail trial proceedings held on Saturday, 07 February, before Anti-Terrorism Court–I. The proceedings reflected clear bias and prejudice against BYC leaders and appeared to be conducted merely to legitimize an already predetermined outcome, thereby undermining the very essence of a fair trial.
During the hearing, the conduct of the court was deeply alarming. The presiding judge repeatedly interrupted defense counsels, made dismissive remarks, and adopted an overtly hostile posture toward the accused. Such behavior constitutes a blatant violation of the principles of natural justice and the constitutional guarantees enshrined in Article 10-A of the Constitution of Pakistan.
BYC leaders consequently lost all confidence in the trial court’s ability to ensure a fair and impartial trial. Dr. Mahrang Baloch formally placed her strong objections on record, stating that she had consistently observed misbehavior toward defense counsels and the passing of multiple orders that violated fundamental rights and were contrary to the spirit of the constitutional right to a fair trial. These actions amount to serious illegalities and irregularities and were ultra vires the lawful jurisdiction of the court.
When Dr. Mahrang Baloch raised concerns regarding judicial bias and lack of fair conduct, the presiding judge, Muhammad Ali Mubeen, responded aggressively and stated, “Who will listen to you and your defence counsels?” He further remarked, “There is no one to listen to your voice.” Such statements, attributed to a judicial officer during open court proceedings, are wholly incompatible with judicial ethics, independence, and the duty to uphold justice.
This conduct exemplifies the attitude adopted by the court toward BYC leaders throughout the proceedings. Defense counsels, relying on settled legal principles, argued that where an accused loses confidence in a judge and raises credible concerns of bias, it becomes the legal and moral obligation of the judge to refer the matter to the Registrar of the High Court for appropriate action, including the transfer of the case to another competent court. Despite these submissions, the ATC judge refused to make such a reference and declined to meaningfully hear the arguments of the defense.
The Baloch Yakjehti Committee unequivocally states that it has no trust in Anti-Terrorism Court–I with regard to ensuring a fair trial. This case is not merely about the prosecution of BYC leaders; it represents a direct assault on the rule of law and the fundamental rights of citizens.
By way of background, the cases against BYC leaders stem from their peaceful political and human rights activities, including advocacy against enforced disappearances, extrajudicial practices, and longstanding systemic injustices in Balochistan. Instead of addressing these concerns through democratic and lawful means, the state has increasingly resorted to criminalization and coercive legal measures to silence voices of dissent.
The Baloch Yakjehti Committee calls upon the higher judiciary to take immediate notice of this grave miscarriage of justice and to ensure the protection of constitutional guarantees. BYC further urges the international community, human rights organizations, and independent observers to closely monitor these proceedings and take cognizance of the ongoing violations of fundamental rights in Pakistan.

Balach Bali is a lecturer at the Computer Science Department of the University of Turbat who was forcibly detained when on his way home yesterday from Turbat. He has been performing his duties and was spending most of his time in university. His forced disappearance is an indication that state institutions are not willing to establish an educated Baloch society.
We have already observed a surge in enforced disappearances of the educated class. Students were already under the threat of going illegally detained by the security forces and now the trend is gradually involving teachers, lecturers and professors as well.
This is the only state where teachers and students are considered a threat. What they have been focusing on is developing a welfare society and bringing fruitful societal outcomes which should be any state’s primary goal. But situations are diverse here.

Yesterday, during the jail trial, once again, the Counter-Terrorism Department (CTD) failed to submit the complete challans in the BYC leadership case. The case is being deliberately prolonged through delaying tactics. Since the very beginning, the CTD has consistently avoided submitting the full challans, while the court has continued to support these delaying maneuvers. Despite failing to submit the complete challans, the court is in a hurry to frame the case based on the incomplete challan. However, the case should only proceed once all challans have been properly submitted. Unfortunately, the court appears to be supporting the CTD’s irregular approach.
From the outset, the CTD has produced a series of fabricated FIRs against BYC leaders, despite the judge previously remarking during hearings for physical remand that all FIRs against the BYC leadership should be presented at once. Following those remarks, the CTD had produced more than twenty-five fake FIRs. But in the ongoing hearings, the CTD is providing challans that include new FIRs against BYC leaders which were not presented before. This not only proves that the state is weaponizing its legal system against Baloch human rights activists but also tarnishes the credibility of the judiciary itself.
Furthermore, in four similar cases, the Khuzdar Anti-Terrorism Court has granted bail to the BYC leadership. Yet, in Quetta, the Anti-Terrorism Court continues to prolong these proceedings. This clearly indicates that, in the BYC leadership case, the judiciary seems to be paralyzed from taking legal action and is indirectly acting on the side of power.
During yesterday’s proceedings, Dr. Mahrang asked the judge whether freedom of speech exists in this country. The judge replied, “Yes, there is, and it is a constitutional right of every citizen.” However, in practice, there is no freedom of speech, as all the cases against the BYC leaders are based on their public speeches. The very judge who acknowledges freedom of speech as a constitutional right is himself denying it by following the orders of intelligence agencies rather than the judicial system.
We appeal to human rights organizations to take immediate notice of the state’s misuse of the law against human rights defenders and to play their role in ensuring the release of the BYC leadership.

For the past six months, there has been a systematic and deliberate delay in the legal proceedings concerning the detained leadership of the Baloch Yakjhati Committee (BYC). The central organizer, Dr. Mahrang Baloch, along with central leaders Bebagar Baloch, SibgatUllah Shah Ji, and activists Beebow Baloch and Gulzadi Baloch, have been subjected to prolonged and unlawful detention.
After an extended period of physical remand, the BYC leadership was transferred to Hudda Jail, Quetta, under judicial remand, continuing their detention without due process. The Counter Terrorism Department (CTD) has deliberately failed to submit the required complaint report, even fifteen days after the last court hearing before the magistrate. The court’s extensions of the report submission deadline reflect a troubling pattern of collusion between the judiciary and state agencies, systematically delaying the proceedings against the BYC leadership.
Recently, the jail administration informed the detained BYC leaders that their next hearing would be held inside the jail instead of in court, citing alleged “security reasons.” This constitutes a clear violation of their fundamental rights and breaches both domestic and international laws. Such actions appear designed to prolong their detention and inflict psychological pressure on the detainees.
In addition to these procedural violations, disabled activist Bebagar Baloch is facing serious health complications. Despite requiring immediate medical care, jail authorities have failed to provide the necessary treatment. Bebagar, who has previously undergone two surgical operations, is currently suffering from a severe urinary stricture blockage, which medical professionals have advised requires urgent surgical intervention. The denial of essential medical treatment represents a grave violation of humanitarian standards and prisoners’ rights.
We urgently call upon the United Nations, international human rights organizations, and civil society actors to take immediate notice of this situation and exert pressure on the Government of Pakistan to uphold its obligations under international law—ensuring fair trial rights, adequate medical care, and effective legal remedies for the detained BYC leaders and activists.
