But as per RBI Circular RBI/2006/167 https://t.co/399hmCiE9I.BP.40/21.04.158/2006-07, the guidelines for banks in this regard are very clear and directive.

The outsourcing of any activity by bank does not diminish its obligations, and those of its Board and senior management, who have the ultimate responsibility for the outsourced activity.

Banks would therefore be responsible for the actions of their service provider including Direct Sales Agents/ Direct Marketing Agents and recovery agents

RBI should stop this third party recovery so as that banks can’t get away with this kind of thing. As this is like if I say I didn’t kill person A, but I just gave contract to someone to do anything to A, not specific to kill.

Of course, she is not your employee, but for sure, she is employee of some company to whom you have given contract to recover the loan.
And you can’t get away with this because until and unless Bank gives Company a green light to misbehave with customers, then Company doesn’t as they have to follow the rules setup by bank who is paying them.
