Religious Affairs Minister has no business to threaten syariah charges against Wan Sabrina.
1. Religious affairs minister Naim Mokhtar has threatened to file syariah offence charges against Sabronzo (Wan Sabrina Wan Rosli ) over a music video - allegedly for being “too sexy”.
2. The Minister has no business whatsoever to make such threats. A government minister has no authority to investigate or prosecute citizens.
3. Prosecutions, whether civil or syariah, can only be decided on by the prosecuting authority, after a fair & impartial investigation by the relevant investigative bodies.
4. By launching this tirade against Wan Sabrina, the Minister has publicly shamed her even though she’s not been found guilty of any offence. He has also prejudiced her fundamental right to a fair investigation and trial.
5. This whole backlash against Wan Sabrina & her band is sensationalist & displays a distasteful obsession with female purity, whilst ignoring harmful misogynistic attitudes in society.
6. Anyway, how did the minister decide that this music video was too sexy? Did he watch it? What’s the criteria to decide this? Perhaps he should just “have lowered his gaze”.
7. It would be best if Naim and his Ministry, instead of scrutinising Dolla’s performances, should focus on real problems. For example, thousands of children who are denied citizenship just because their parents marriage documents are not in order. Isn’t defending innocent children our highest religious duty?

X’mas trees are a global cultural symbol. Please do not insult the ordinary Muslims of Malaysia. Surely our aqidah is not so shaky that the sight of a X’mas tree can affect it.
Has the Fatwa Council visited any of the major shopping malls in the country? KLCC, Megamall, Pavilion etc?
There are giant X’mas trees all over these malls. And thousands upon thousands of Muslims visit these malls all the time.
They even take pictures with the X’mas trees.
In short, the fatwa guideline is pointless & divisive, and the people are rightly paying no attention to it. Just scrap it.

Tindakan Terengganu jalankan sebatan awam terhadap Mohd Affendi Awang tersasar dari Islam
1. Hukuman kontroversi sebatan awam oleh Mahkamah Tinggi Syariah Terengganu terhadap Mohd Afendi Awang atas tuduhan khalwat tidak boleh diterima dan bercanggah dengan ajaran Islam.
2. Hukuman itu dilaksanakan hari ini dan tidak mendatangkan apa-apa faedah kepada negara.
3. Pertamanya, hukuman sebat bagi kesalahan yang dikenali sebagai khalwat tidak terdapat dalam Islam. Berikut sebabnya.
4. Enakmen Kesalahan Jenayah Syariah Terengganu 2001 mentakrifkan khalwat sebagai berniat melakukan hubungan seks luar nikah. Adalah dianggap kesalahan bagi seorang lelaki dan perempuan yang belum berkahwin atau bukan muhrim, untuk ditemui di mana-mana tempat yang terselindung atau di dalam rumah atau bilik dalam keadaan yang boleh menimbulkan syak.
5. Bagaimanapun, "niat" untuk melakukan kesalahan tidak sama dengan melakukan kesalahan itu.
6. Menurut Islam – niat melakukan perbuatan jahat atau kesalahan tidak diambil kira, berbeza dengan niat melakukan kebaikan.
7. Dalam apa jua keadaan, menurut Islam, hukuman hudud adalah khusus untuk kategori-kategori kesalahan berikut– iaitu zina (persetubuhan haram), qadhf (tuduhan palsu zina), meminum minuman keras (shurb al-khamr), mencuri (sariqa), rompakan (hiraba), murtad (riddah), dan khianat (baqhy).
8. Khalwat tidak termasuk dalam mana-mana kategori di atas.
9. Berbalik kepada rancangan menjalankan sebatan di khalayak ramai yang telah menjadi kebimbangan negara. Apakah objektif menjalankan hukuman ini secara terbuka? Mengaibkan Affendi secara terbuka?
10. Ia bertentangan dengan konsep yang sangat penting di dalam Islam - iaitu untuk tidak membuka aib orang lain sama seperti mana kita tidak mendedahkan aib kita sendiri, kerana Islam sangat menitikberatkan maruah manusia.
11. Seseorang tidak seharusnya mencari kesalahan yang dilakukan secara tertutup, malah perlu menutup mata terhadap dosa peribadi. Konsep ini berakar umbi dalam Al-Quran, yang melarang tajassus (Al-Quran, 49:12):-
"Wahai orang-orang yang beriman! Jauhilah kebanyakan dari sangkaan (supaya kamu tidak menyangka sangkaan yang dilarang) kerana sesungguhnya sebahagian dari sangkaan itu adalah dosa; dan janganlah kamu mengintip atau mencari-cari kesalahan dan keaiban orang; dan janganlah setengah kamu mengumpat setengahnya yang lain. "Adakah seseorang dari kamu suka memakan daging saudaranya yang telah mati? (Jika demikian keadaan mengumpat) maka sudah tentu kamu jijik kepadanya. (Oleh itu, patuhilah larangan-larangan yang tersebut) dan bertaqwalah kamu kepada Allah; sesungguhnya Allah Penerima taubat, lagi Maha mengasihani."
12. Rasulullah (SAW) berulangkali mengabaikan aduan seorang lelaki yang menyatakan dia telah “melanggar salah satu larangan Hudud.” "Jika kamu mencari aib atau memalukan orang," Rasulullah memberi amaran, "Kamu akan merosakkan mereka."
13. Banyak sangat kekhilafan dilakukan dalam kes ini, termasuk hakikat bahawa perbuatan yang bukan zina dianggap sebagai zina, publisiti sensasi dan jemputan kepada orang ramai menyaksikan penghinaan Affendi. Apa kaitan semua ini dengan ajaran agama Islam yang maha adil dan penyayang?
14. Amat mendukacitakan apabila sekali lagi Islam dituduh sebagai kejam; padahal sebenarnya falsafah di sebalik syariah dan hudud adalah mengenai keadilan, perbuatan yang baik dan mengenai maruah manusia. Falsafah inilah yang kini dihapuskan dalam kes di Terengganu.
15. Terus-terang saya katakan, perkara mengenai Islam di negara ini telah menjadi perlawanan politik tidak berkesudahan untuk melihat "siapa lebih Islam daripada yang lain", melibatkan pihak dalam kerajaan mahupun pembangkang. Kedua-duanya memperalatkan Islam dalam perlawanan ini demi meraih undi Melayu Muslim, di mana yang menjadi mangsa penganiayaan adalah orang seperti Affendi.
The public caning of Mohd Affendi Awang in Terengganu is unIslamic!
1.The controversial sentence of public caning by the Terengganu Syariah High Court against Mohd Afendi Awang for alleged Khalwat is unacceptable and against the precepts of Islam.
2.The sentence is to be carried out today, and if it is, no good will come of it for this country.
3.Firstly, whipping for the offence known as Khalwat is not Islamic. The reason is this.
4.The Terengganu Syariah Criminal Offences Enactment 2001 defines khalwat as an act preparatory to sex out of wedlock. It is considered an offense for a man and a woman who are not married or related to be found together in a secluded place under circumstances that may give rise to suspicion of immorality.
5.But ‘preparatory’ to an offence is not the same as committing an offence.
6.Under Islam – having niat to commit a bad deed/offence is not counted but having niat to commit a good deed matters.

8.Khalwat does not come close to any of the above categories.
9.Going back to this planned public whipping which has become a national concern. What is the objective of conducting this publicly? Of shaming Affendi publicly ?
10.This runs foul against a very important concept under Islam – which is to protect from shaming others ( “buka aib’ ) just as we should not expose our own aib, because Islam highly emphasizes human honour.

These concepts were rooted in the Quran, which forbids tajassus (Quran 49:12), : O ye who believe! Nay, ye would abhor it...But fear Allah: For Allah is Oft-Returning, Most Merciful.
12. The Prophet (peace be upon him) repeatedly ignores a man trying to confess to having “violated one of the Hudud. “If you seek out a people’s secret or shameful areas,” the Prophet warns, “You’ll ruin them.”

14.Its a matter of great sadness that once again Islam is being given a bad name as being harsh and cruel; when in fact the philosophy behind Syariah and hudud is all about justice, right conduct and human dignity. That philosophy is being subverted in the Terengganu case.
15.Let me be very blunt about this. Matters related to Islam in this country have deteriorated into an endless political contest of ‘who is more Islamic than the other’, waged between those in government now and the opposition. Both use Islam in a cynical contest for the Malay Muslim vote, and in the process victimise ordinary Muslims like Affendi.
