No Guarantee of Delivery: The updated terms confirm that a deposit "does not guarantee that a Device will be produced or made available for purchase," and that estimated ship dates, launch timelines, or anticipated production schedule are non-binding estimates only".
"Non-refundable" Concerns: While the company has indicated it might refund if it cancels the project, reports suggest many users feel the deposits are functionally non-refundable due to the vague, extended, and uncertain delivery timeline, and that the terms indicate the deposit "does not create a contract for sale".
Contractual Language: The updated terms state that the deposit is "not a purchase," does not create a "binding legal contract," and is instead described as a "conditional opportunity to buy the device if Trump Mobile later elects, in its sole discretion, to offer the Device for sale".
Waiver of Claims: The terms also stipulate that, to the maximum extent permitted by law, buyers waive the right to pursue claims beyond the original deposit amount if the project is delayed or canceled.
