بعد أن امتلأت المقابر… فُتحت أبواب الزيارة

إن السماح أخيرًا للجنة الدولية للصليب الأحمر بزيارة الأسرى الفلسطينيين بعد أكثر من عامين من العزل والإخفاء والتعذيب، لا يمكن اعتباره إنجازًا إنسانيًا يُشاد به، ولا خطوة استثنائية تُمنح على سبيل التفضّل، بل هو إقرارٌ قضائي متأخر بواجب قانوني وأخلاقي كان ينبغي احترامه منذ اللحظة الأولى لاعتقال هؤلاء الأسرى.
فتمكين اللجنة الدولية للصليب الأحمر من الوصول إلى المحتجزين، ومتابعة أوضاعهم الصحية والإنسانية، ونقل المعلومات المتعلقة بهم إلى ذويهم، يُعد من أبسط الضمانات التي كفلتها قواعد القانون الدولي الإنساني، وفي مقدمتها اتفاقيات جنيف، التي وُضعت أصلًا لحماية الأشخاص المحرومين من حريتهم أثناء النزاعات المسلحة، ومنع تحويل السجون إلى مناطق معزولة عن الرقابة والمساءلة.
لكن المفارقة التي تثير مرارة تفوق السخرية، أن دولة تُقدَّم للعالم بوصفها “الديمقراطية الوحيدة في الشرق الأوسط”، احتاجت إلى أكثر من عامين حتى تسمح لجهة إنسانية دولية بأداء مهمة يُفترض أنها حق أصيل لا يخضع للمساومة أو الانتظار.
وخلال هذه السنوات، مات أسرى تحت التعذيب، واختفى آخرون قسرًا، وتحوّلت السجون إلى أماكن يُدفن فيها الإنسان حيًا، بينما وقف العالم متخمًا بخطابات حقوق الإنسان، عاجزًا حتى عن فرض زيارة إنسانية بديهية نصّت عليها ��لقوانين الدولية منذ عقود.
لقد فُتحت أبواب الزيارة أخيرًا… لكن بعد أن امتلأت المقابر، وبعد أن غاب كثير ممن كان ينبغي أن تصل إليهم تلك الزيارات أحياء.

After the Graves Were Filled… the Doors Were Finally Opened

Allowing the International Committee of the Red Cross to finally visit Palestinian detainees after more than two years of isolation, enforced disappearance, and torture cannot be portrayed as a humanitarian achievement or an exceptional gesture of goodwill. Rather, it is a delayed judicial acknowledgment of a legal and moral obligation that should have been respected from the very first moment these prisoners were detained.
Granting the International Committee of the Red Cross access to detainees, monitoring their humanitarian and medical conditions, and conveying information about them to their families constitutes one of the most basic guarantees established under international humanitarian law, particularly the Geneva Conventions, which were originally designed to protect persons deprived of liberty during armed conflicts and to prevent prisons from becoming zones isolated from oversight and accountability.
Yet the bitter irony surpassing satire itself lies in the fact that a state presented to the world as “the only democracy in the Middle East” required more than two years before permitting an international humanitarian organization to perform a task that should never have been subject to negotiation, delay, or political bargaining.
Throughout those years, prisoners died under torture, others were forcibly disappeared, and detention centers became places where human beings were buried alive, while the world — overflowing with speeches about human rights — stood incapable of enforcing even the most basic humanitarian visitation rights guaranteed by international law decades ago.
The doors to visitation were finally opened… but only after the graves had already been filled, and after many of those who should have received such visits were no longer alive to see them.
