Brian Tamaki gun licence revocation based on undefined thresholds

The Firearms Safety Authority has apparently revoked Brian Tamaki's firearms licence based on vague, undefined thresholds of hatred and extremism. After seven weeks of looking into his public comments, there have still been no charges laid, but his licence has been revoked anyway.

"This is not just about Brian Tamaki," says Free Speech Union Council Member Douglas Brown. "The Arms Act lets an official decide what constitutes 'hatred' or 'extremism' without defining either word or meeting a threshold of evidence. There are several offences that relate to hatred and extremism, but the Police don't need to lay any charges to revoke a licence on these grounds."

Section 24A(1)(l) of the Arms Act 1983 allows a finding that a person is not fit and proper to hold a licence if they have "shown patterns of behaviour demonstrating a tendency to exhibit, encourage, or promote violence, hatred, or extremism". Neither hatred nor extremism is defined in the Act, and nothing in the provision requires evidence that the person has used or may use their firearms dangerously. Police may also weigh "any other relevant matters" they consider appropriate, using information obtained "from any source".

The Firearms Safety Authority, whose decisions are mostly made by seconded Police officers, suspended Tamaki's licence and seized his firearms on 30 June. On Friday, his licence was revoked. He cannot re-apply for another for five years unless the decision is reversed. Tamaki says he will seek a review. If that is unsuccessful, he may appeal the decision.

The reasons the deciding Police officer gave were about what Tamaki said, not how he handled his firearms. Extracts of the decision Mr Tamaki has published say the Police were not concerned with his wish to protest against the Indian Prime Minister, or with expression others might find confronting, but with statements they judged to be "calculated, direct, unequivocal, and repeated". "You encouraged and promoted violence and significant property damage," the decision allegedly says.
