# When doctors were forced to put their lives on the forefront during the battle against Covid 19 with minimum knowledge about the disease and less than minimum access to protective gear,you didn’t care. Did you think that the virus would shy away from infecting us just bcos we had a medical degree? What did the society do then- you pelted us with stones when we entered your houses to check on you, you asked us and our families to vacate your houses and societies, you shamelessly spoke to us only when you became covid positive or required oxygen or a hospital bed and then you cursed us because you had to spend so much for your treatment. Did you care for the doctors, nurses, paramedical staff and Hospital workers who had to take a huge risk for themselves and their families but still turned up for work daily?

You didn't speak up then, so shut up now.

# When doctors were being litigated against, beaten, assaulted, stabbed, on a regular basis.

# When cricketers and actors earn in crores but doctors are despised for charging for their services even in few hundreds or thousands,

# During our strikes, we are still continuing with emergency patient services. This never happens in any other profession. When lawyers strike work, do you hear of anyone turning up for an emergent hearing? Patients die everytime due to bandhs by political parties,

# When people "subscribe to ,view, like" and trust posts from you- tube influencers on medical issues rather than qualified doctors on the same topic they suffer the consequences,

# Last but not the least, you did not find it in your heart to feel deeply for one of our own who was savagely raped and murdered whilst on duty ,as well as all the things that happened afterwards .So, please don't feel for any hypothetical patient suffering that might be caused by our one day strike. Use Google, diagnose and treat those patients - play doctor for a day (but do pray nobody rapes or assaults you during that one day)

Alternative medicine practitioners allege that I have a propaganda against them through my X handle. They claim that my clinical practice and "business of healthcare" suffer because alternative medicine is now favored more and I'm losing patients.

On the contrary, my handle and account on X exist solely for helping public and patients and cutting it off even for a while, is a disservice.

Like this father son duo, who found me through a follower of mine from Kolkata on X and through another common follower in Delhi, got my details to meet me at Kochi.

The father suffered from liver failure due to consumption of traditional Ayurvedic herbs and was given three months to live without a transplant as his liver failure progressed rapidly.

Since the son was ready for donating a part of his liver to save his father, I advised them to come to Kochi. They did not have any money. But that was not the main concern for us. Either I would write off his death certificate or he would go home fully cured.

They came.

Two days back, we discharged him home after spending a month with us and undergoing a liver transplant for free. We took this picture together before they left for their hometown, and the son, gave me his permission to share this story.

I say what I have to say, for this.

People, especially modern medicine doctors, who in my absence, proclaimed my rudeness or arrogance and called my statements egoistic or abusive are small minds who cannot fathom what I focus on. It's easy for strangers to judge others (erroneously) on social media and disrupt everything done in good faith.

You have no idea what the bigger picture of clinical medicine is and would probably not understand it, in this life.

I am happy to be back doing what other doctors would/could never do, as long as I can, to help the people and patients. My methods maybe unapologetically sharp, factual and truthful and I intent to keep it that way.

In colonial India there were a few Medical Colleges & several other Medical Schools. Rarely do people know the difference. Medical Colleges awarded a graduation degree in medicine & surgery (which is known as M.B.B.S now) while Medical Schools awarded Licentiate in Medical Practices (L.M.P or L.M.& S). Licentiates weren’t full fledged doctors and supposed to work as assistants of doctors. They weren’t eligible to take admission in M.D or M.S unlike the graduates of Medical Colleges. Medical Colleges had a uniform curriculum governed by the Medical Council of India (before that they were governed from England) and awarded university degrees. Medical Schools weren’t governed through the Medical Council, thus no uniformity in curriculum and degrees weren't from a university. Interestingly, the Licentiate program was also of 5 years duration like a Medical degree but with less curriculum. By the end of 1938, India had 27 Medical Schools apart from 10 Medical Colleges where Stanley Medical School, Madras was considered the best.
Sir Joseph Bhore committee report of 1946 recommended the upgradation of Medical Schools to Medical Colleges, allowing licentiates to gain M.B.B.S with a bridge course & gradually discontinuing the licentiate degrees.

Bengaluru Civil Court passes ex-parte injunction order to X to suspend the account of Dr Cyriac Abby Philips (@theliverdoc).

The order was passed in a suit filed by Himalaya Wellness Corporation which alleged that @theliverdoc made defamatory allegations against the company.

The Case against @theliverdoc

Simply by reading the court order, it appears that the Plaintiff's position raises concerns about free speech. I wish I had the entire complaint to examine each claim in detail.

Background:
This case appears to be based on a Twitter thread consisting of 28 tweets posted by #TheLiverDr in May 2021.

Here's a quick rebuttal:
1. The sum and substance of the case of the plaintiff is that the Defendant No.1 is posting derogatory statements and materials against the products of the plaintiff company and due to the said act of the Defendant No.1 the business of the plaintiff company has substantially reduced.

The word 'derogatory' means unkind, unflattering, critical, disrespectful, or demeaning.

For example, if I buy an expensive phone and the camera quality is terrible, or the laptop I purchased keeps shutting down, and I share my critical thoughts or warn others on a forum about the product's issues, that doesn't amount to defamation.

Now, think about a fact-checker exposing fraudulent activities by an insurance company. Should the fact-checker be held liable just for being critical or unkind to the company? No.

After reviewing the alleged 28 tweets, I found the thread incredibly helpful. It was based on solid evidence, research, links, and scientific analysis of various product ingredients. @theliverdoc provided relevant explanations with citations from authoritative sources.

The author's intent was not personal gain or wrong motives but to inform the public about pseudoscience scams in the 'health wellness' industry out of goodwill.

2. According to the plaintiff, the said statements and materials posted in twitter (hosted by the Defendant No.2) are perse false and not justified one

In tweet #14, the author fact-checks the plaintiff's claim of having 300 research papers. He did a live search on PubMed and found only 86 articles. Out of those 86, only 7 involved humans.

It's important to note that these research papers were not posted on Defendant No.2 (formerly Twitter), but rather on the National Library of Medicine's website at https://t.co/4oliMG0J0g.

So my question is whether National Library of Medicine has been made as a party to the suit?

3. According to him, the practice of the Defendant No.1 in making such publication is noting but cut throat competition with the products of the plaintiff company with sole intention to push the products of the Cipla and Alchem are promoted.

This statement could be seen as defamatory against #theliverdr. The plaintiff must provide strong evidence to support such a claim; otherwise, #theliverdr could counter by filing a defamation lawsuit against the plaintiff.

4. The judgments also indicate that there is a need to issue ad- interim ex-parte injunction directing the party who is posting such materials to remove them at the earliest so as to minimize the damage caused to the person who is affected by such postings in any manner like loss of reputation, loss of income in monitary terms and disservice to the consumers who are benefited by the products like Liv-52.

@theliverdoc is not just an anonymous internet user; he's a qualified doctor specializing in liver diseases. He's highly respected and admired by peers, science advocates, and the general public.

Issuing ad interim ex-parte injunction without giving him a chance to be heard goes against the principles of natural justice.

5. In other words, the urgency made out by the plaintiff company would show that an immediate order has to be passed as sought for in IA No.1 and 2 of 2023 before issuing notice against the Defendants.

The Twitter/X thread in question is from May 2021, which is over 2 years ago. There's no current urgency that justifies an ex-parte injunction at this point.

6. In the facts and circumstances issue ad-interim ex- parte temporary injunction order restraining the Defendant No.1 from tweeting, making or publishing, re-tweeting and re- publishing defamatory remarks against the plaintiff company and / or the products of the plaintiff company till next date of hearing. In the facts and circumstances issue ad-interim ex- parte mandatory injunction directing the Defendant No.2 to suspend/block the social media handle of the Defendant No.1 bearing link “ https://t.co/DD1EpOVfFZ? ref_src=twsrc%5Egoogle %7Ctwcamp%5Eserp%7Ctwgr %5Eauthor ” till next date of hearing.

TheLiverDr has actively countered numerous false claims and misinformation about public health through thousands of tweets, posts, and reposts.

Suspending his entire account is an extreme measure. Instead, the appropriate action would have been to withhold or deactivate only those specific tweets or posts related to the plaintiff's products.

I muted @theliverdoc a couple of weeks back primarily because I felt he was getting too confrontational and disrespectful towards others.

But in a country where the social media is full of blatant false claims on health, and modern medicine is often vilified, he was a voice of reason. And a forceful one
Had he engaged better with people, especially with fellow doctors, it would have amplified his voice and he would have gotten much better support on medtwitter.
But in this fight , I would still stand in support of @theliverdoc
