✅Here are 5 important clauses every landlord should insist on:

1️⃣ Inspection Clause
This clause gives the landlord the right to inspect the property periodically upon giving reasonable notice to the tenant.

📌 Practical Example:
A landlord discovers after two years that a tenant has converted a residential apartment into a mini warehouse, causing serious structural damage. Regular inspections could have detected the issue much earlier.

2️⃣ Prohibition of Illegal Activities Clause
Your agreement should clearly state that the property must not be used for any unlawful purpose.

📌 Practical Example:
Where a property is used for criminal activities, law enforcement agencies may investigate the premises, creating serious legal and reputational problems for the owner.

3️⃣ Rent Default Clause
This clause should specify the consequences of late payment or non-payment of rent.

📌 Practical Example:
Without a clear provision, recovering possession from a defaulting tenant can become unnecessarily complicated and expensive.

4️⃣ Subletting Restriction Clause
A tenant should not transfer possession of the property to another person without the landlord's written consent.

📌 Practical Example:
Some landlords are shocked to discover strangers occupying their property because the original tenant secretly sublet the apartment.

5️⃣ Damage and Maintenance Clause
Clearly define who is responsible for repairs and maintenance.

📌 Practical Example:
A leaking roof left unattended by a tenant causes extensive damage to the building. A well-drafted agreement helps determine responsibility and liability.

Your Neighbour Built A Fence On Your Land. Here Is How To Get It Removed Without A Fight, And Why You Must Act Fast.

Most Nigerians in this situation do one of two things. They confront the neighbour aggressively and things escalate badly.

Or they ignore it and hope it resolves itself. Both approaches are wrong and one of them has serious legal consequences.

Here is what to actually do.

First — Confirm The Encroachment Officially

Before you accuse anyone of anything you need professional confirmation that the fence is actually on your land and not on theirs.

Engage a licensed surveyor to conduct a fresh boundary survey of your property.

The surveyor will use your title documents including your survey plan and Certificate of Occupancy to establish the precise legal boundaries of your land and confirm exactly where your neighbour’s fence sits relative to those boundaries.

The most important thing to understand about encroachment is that ignoring it can cost you.

Under certain legal doctrines including adverse possession a neighbour who occupies or uses your property openly and continuously for a long enough period can gain permanent legal rights to continue doing so. 

Under Nigerian property law a person who possesses your land openly and without interruption for 12 years or more can potentially claim title to it through the doctrine of long possession. Every day you delay is a day that clock is running.

Act fast. Confirm first. Then move.

Step 1 — Speak To Your Neighbour Directly With Evidence In Hand

A direct respectful conversation with a copy of the survey in hand can sometimes resolve the problem without legal action. If the neighbour agrees to remove the encroaching structure get the agreement in writing. 

Do not go empty handed and emotional. Go with your surveyor’s report showing precisely where your boundary sits and where their fence crosses it. That document turns an argument into a factual conversation.

Many encroachments in Nigeria happen genuinely without malicious intent. A neighbour who receives a survey report showing exactly where they have built will often agree to adjust the fence without needing to involve any authority.

If they agree get it in writing immediately. A signed agreement with a timeline for removal is enforceable under Nigerian contract law.

Step 2 — Send A Formal Demand Letter

If the conversation does not produce agreement send a formal written demand letter stating the nature of the encroachment, the survey findings and a specific deadline of 21 days for voluntary removal.

Send it by registered post. Photograph the moment of delivery. WhatsApp a copy as well.

That letter creates a legal paper trail showing you attempted resolution before going to court and it signals to your neighbour that you are serious enough to have engaged a lawyer.

Step 3 — Apply To Court For An Injunction

If your neighbour ignores the demand letter or refuses to remove the fence your next step is the High Court of your state.

Nigerian courts including the FCT High Court have in recent cases issued injunctions restraining parties from encroaching on land and ordering that the status quo be maintained pending full determination of the matter. 

Your lawyer will file an originating summons for trespass to land and apply for an interlocutory injunction restraining your neighbour from further encroachment while the case is heard.

That injunction can be granted quickly sometimes on the same day preventing any further construction or expansion of the fence onto your land while proceedings continue.

The court can ultimately order the removal of the encroaching fence, award you damages for the period of unlawful occupation and costs of the proceedings.

The Warning You Cannot Ignore

Any delay in objecting to the encroachment increases the risk of the court refusing to order demolition.

The moment you discover the encroachment the clock starts.
