In most states, a judge would weigh the option based on testimony and facts but in Texas its the jury.

@PDaughter124 @MaryAnnreports You're correct those are mitigating circumstances. But those are for sentences within the statutory considerations where a ranged or indeterminate sentence exists. Mitigating circumstances as a defense in sentencing are to lower the range of potential sentencing.
