Apple Intelligence is very likely to be limited in the EU only on iOS/iPadOS, as those two platforms have been declared as "gatekeepers" by the EU DMA regulations.
macOS has not (yet) been declared a gatekeeper by the EU and was fully excluded from all the App Store and Safari concerns.
