🚨🚨“REDUNDANCY” IS NOT A FREE PASS - COURT WARNS EMPLOYERS WHO FIRE AND REFUSE TO PAY
If you’ve ever been told “your position has been declared redundant” and then sent home empty-handed, this one is for you. In Pride Kings Services Ltd v Kennedy Ongoro, the Employment and Labour Relations Court of Kenya sitting in Kisumu dealt with exactly that situation. Kennedy Ongoro was declared redundant, but he was not paid his salary arrears, leave, or severance. The employer insisted everything was lawful. The lower court disagreed and awarded him his dues. The company appealed, trying to overturn that decision.
The High Court, through Hon. Nzioki wa Makau, looked at the facts and cut through the excuses. Yes, an employer can declare redundancy, but the law sets strict conditions. You must notify the Labour Officer, follow a fair process, and most importantly, pay the employee what they are owed. In this case, the employer did none of that properly. There was no proof of payments, no proper process, and the employee’s evidence, including bank statements showing unpaid months, was not challenged. In simple terms: the employer talked compliance, but did not show it.
The Court dismissed the appeal and upheld the employee’s award. The message is blunt and practical: being told “you are redundant” does not mean you leave with nothing. If your employer does not pay your dues, the law is on your side. And for employers playing smart with paperwork while avoiding payment, the courts are catching on.

Most Kenyans only learn how health cover really works when they’re already at the hospital.

Brief explainer on the UHC legislative agenda:
In the run up to the 2022 Presidential election, President @williamsruto promised the delivery of Universal Health Coverage (UHC). Yesterday, Cabinet approved 4 bills for onward transmission to Parliament that shall operationalize UHC.
1. The Primary Healthcare Bill, 2023.
2. The Social Health Insurance Bill, 2023.
3. The Digital Health Bill, 2023.
4. The Facility Improvement Financing Bill, 2023.
1. The Primary Healthcare Bill, 2023.
- The President’s commitment in the Kenya Kwanza manifesto was to employ & initiate payments for community health promoters & integrate preventive & promotive services. The Primary Health Care Bill 2023 establishes a framework, for the delivery of, access to, & management of primary health care.
- It establishes the framework for the 100,000 community health promoters to be commissioned by the President in October 2023 & outlines the services they will offer when they visit households. The bill provides for the re-organization of service delivery at the Primary Health Care levels; including dispensaries & health centers, where the government shall cater for these services.
- This means Kenyans seeking services at these levels can walk in & walk out without incurring any bill.
2. The Social Health Insurance Bill, 2023.
- In the manifesto, the President also promised to provide social health insurance fund coverage for all Kenyans with no exclusions, in the policy of ‘leaving no one behind.’ He also made a commitment to set up the Emergency Medical Treatment Fund to cater to emergencies, cancer treatment & referrals, & to set aside funds for strategic programs & retirees. This commitment will be actualized by the Social Health Insurance Bill 2023, which establishes the authority that shall replace NHIF. The bill establishes 3 funds:
a) A Primary Health Care fund to cater to preventive & promotive primary care services at the community, dispensary, and health centre levels;
b) A Social Health Insurance Fund that shall cover services such as primary referrals, secondary & tertiary services; and
c) A Chronic Illness & Emergency Fund that provides for chronic illnesses like complications of diabetes, hypertension, cancer management, & emergency treatment, as enshrined in our constitution article 43 (2) which reads: 'A person shall not be denied emergency medical treatment.'
These funds are to be managed by a single board & secretariat, based on the proposed 2.75% deductions on household income from both formal & informal sectors.
3.The Digital Health Bill, 2023.
The President also promised an integrated information communication and technology system to enhance telemedicine & health management information systems. The Digital Health Bill 2023 provides a framework for digital health services, data governance, protection of personal health information, & service delivery through digital health interventions.
4. The Facility Improvement Financing Bill, 2023.
The Head of State also promised to allocate dedicated funds for healthcare. This commitment will be realized through the Facility Improvement Financing Bill 2023, which aims to ring-fence money generated in health facilities, ensuring a predictable, regular, and steady source of funding for health facility operations in the counties.

A cheat code I wish I knew at 18:
The 4 Types of Luck
(an animated visualization)
In 1978, a neurologist named Dr. James Austin published a book entitled Chase, Chance, & Creativity: The Lucky Art of Novelty.
In it, he proposed that there are 4 types of luck:
(1) Blind Luck
(2) Luck from Motion
(3) Luck from Awareness
(4) Luck from Uniqueness
Here’s what they are:
Type 1: Blind Luck
Completely out of your control:
• Where you are born
• Who you are born to
• Base circumstances of your life
• “Acts of God”
These are the truly random occurrences of the universe.
Type 2: Luck from Motion
You’re creating motion and collisions through hustle and energy that you are inserting into an ecosystem.
You increase your luck surface area through simple movement.
The increase in collisions opens you up to more lucky events.
Type 3: Luck from Awareness
Depth of understanding within a given arena allows you to become very good at positioning yourself for lucky breaks.
Naval says: “You become very good at spotting luck.”
You can “spot luck” from a mile away because of your knowledge and experience.
Type 4: Luck from Uniqueness
Your unique set of attributes attracts specific luck to you.
“[This type] favors those with distinctive, if not eccentric hobbies, personal lifestyles, and motor behaviors.” - Dr. James Austin
Type 4 Luck actually seeks you out.
The Stages of Luck
I personally think of Types 1-3 as coming in stages as you grow up:
• Type 1 dictates your early years
• Type 2 as you hustle in your 20
• Type 3 as you gain experience in your 30s+
Type 4 is unique—it’s dislocated from age.
Always remember my Luck Razor:
When choosing between two paths, choose the path that has a larger LUCK SURFACE AREA.
Your actions put you in a position where luck is more likely to strike.
It’s hard to get lucky watching TV at home—it’s easy to get lucky when you’re engaging and learning.
