Many Kenyans believe that a title deed is an iron shield and that a person who forcefully enters property can never legally own it. The Court of Appeal has delivered a painful lesson in Mohammed Azhar v Hardev Kalsi Singh [2026]. The dispute involved a Nairobi property that had remained under the names of several family members. In 1987, Hardev Kalsi Singh moved into the premises and remained there openly, exclusively, and continuously. For decades, the registered owners watched from a distance. Some wrote letters demanding rent, others issued threats and eventually filed proceedings before the Business Premises Rent Tribunal. But by the time they attempted to assert their rights, twenty-five years had already passed. The battle that followed reached the Court of Appeal, with the owners insisting that the occupier had entered forcefully and was merely a tenant.
The Court of Appeal rejected those arguments and handed down a devastating reminder to property owners. The judges held that adverse possession does not require peaceful entry in the ordinary sense. What matters is that occupation is open, continuous, exclusive, and without permission for at least twelve years. Letters demanding rent, notices to vacate, auctioneers, and even proceedings seeking rent were found to be legally insufficient to stop time from running. The Court emphasized that only regaining possession or filing a suit specifically aimed at recovering the property can interrupt adverse possession. By waiting twenty-five years, the registered owners had effectively allowed the occupier's rights to mature, and their title had already been extinguished by operation of law.
The implications are frightening for landowners, heirs, and families with old properties. Paying land rates, holding a title deed, or sending demand letters may not save your land. If someone occupies your property openly and you fail to move decisively, the law may eventually recognize the occupier instead of you. Many Kenyan families have inherited plots and buildings they rarely visit, assuming the title alone offers protection. This judgment is a stark warning: ownership is not preserved by paper alone. Landlords who merely complain, send advocates' letters, or demand rent while avoiding the harder step of recovering possession may wake up one day to discover that the law has quietly transferred their property to the very people they considered trespassers. In land matters, sleeping on your rights can be more expensive than losing a court case - it can cost you the land itself.

It was good that the entire judgment was read word for word and broadcasted live for ten hours to the entire Kenyan public. How else would you have understood the problems we keep pointing out daily about incompetence, misconduct and misbehavior by a Judges?
That very right is sacrosanct and inviolable. It's concerning that the court would arrive at the conclusion that it was infringed and still go ahead and uphold the impeachment.
