25 września, w ostatnim dniu przewidzianym na decyzję, Prezydent Karol Nawrocki podpisał ustawę wdrażającą część unijnego aktu o usługach cyfrowych (DSA). Koordynatorem ds. usług cyfrowych zostanie Prezes UKE, a za łamanie DSA grożą kary sięgające 6% światowego obrotu.

Najbardziej kontrowersyjny element – administracyjne usuwanie treści uznanych za nielegalne, który był głównym powodem styczniowego weta – rząd wydzielił do osobnego projektu (druk nr 2693). Sejm wciąż nad nim pracuje. Rząd nie porzucił tego pomysłu, tylko go przeniósł.

Podpisana ustawa nadal budzi jednak poważne wątpliwości:

➡️ Osłabia prawo do sądu. Gdy użytkownik pozwie platformę za usunięcie wpisu, a organ administracji wszczął postępowanie w tej samej sprawie, sąd obowiązkowo zawiesza proces – a ustalenia urzędu go wiążą. O granicach wolności słowa przesądzi urzędnik, nie sędzia.

➡️ Organ może nakazać dostawcy „uniemożliwienie dostępu do treści”. Stroną tego postępowania jest tylko platforma – autor blokowanego wpisu nie ma w nim nic do powiedzenia.

➡️ Zaufane podmioty sygnalizujące, których zgłoszenia platformy rozpatrują priorytetowo, nie muszą spełniać żadnych konkretnych wymogów niezależności – także finansowej. Status mógłby uzyskać podmiot w całości utrzymywany z publicznych pieniędzy.

➡️ Ustawa pozwala tym podmiotom wytaczać powództwa i wstępować do procesów – czego DSA nie przewiduje. Ten sam podmiot może zgłaszać treści do usunięcia i występować w sądowych sporach o moderację.

Jak pokazał przykład niedawnych wyborów na Węgrzech, cenzurowanie treści przez zaufane podmioty – nawet prawdziwych – wpłynęło na wynik głosowania. Zasadne są obawy, czy podobne próby nie czekają Polski przed przyszłorocznymi wyborami do Sejmu i Senatu.

Rzeczywista batalia rozegra się o druk nr 2693. Sama idea usuwania treści decyzją urzędnika wciąż pozostaje mocno wątpliwa z punktu widzenia prawa do sądu.
