point of information at 42:10... FD&CA clearly defines tobacco products as things made from tobacco leaves. It was deeming then continuing resolutions that made nicotine the lynch pin of FDA tobacco regulations. Nicotine could have just as easily ended up in the same family as non-pharmaceutical health products available on amazon and GNC, but congress cant seem to pass laws or budgets and just lets members throw things into the CR.
