‼️The Supreme Court ruled that states and schools can protect women and girls by banning men from women's sports teams. In a multifaceted ruling, the Court held 9-0 that banning biological males from female sports does not violate Title IX, while the Justices ruled 6-3 that the ban does not violate the Equal Protection Clause.

This ruling resolved two consolidated landmark cases, Little v. Hecox and West Virginia v. B.P.J, involving Idaho’s 2020 “Fairness in Women’s Sports Act,” and West Virginia’s 2021 “Save Women’s Sports Act." We filed an amicus brief to the High Court stating that Title IX is based on sex, not gender identity, and any interpretation otherwise that prioritizes protections for gender identity could eliminate Title IX’s sex-based protections for women. 

➡️“A man does not have a legal right to compete against women just because he believes that he is a woman,” wrote Justice Clarence Thomas in his concurring opinion. “… Men and boys with gender dysphoria are not women or girls, even if they believe that they are. Sex is an immutable ‘biological' characteristic; it is binary; and ‘man’ and ‘woman,’ ‘boy’ and ‘girl,’ are the terms that correspond to adults and children of each sex. To use language to obscure reality—to show ‘indifference regarding the truth’— is to lie to the public and cease to treat our fellow citizens ‘as equal[s].’”

Biological reality dictates that men and women are different — keeping boys out of girls' sports preserves the entire purpose of Title IX and protects women in athletics. 🏅🥎⚽🏀🏐🎾

Massive Supreme Court victory for women’s sports!

In two landmark rulings, the Court has upheld the women’s sports laws of West Virginia and Idaho, which define “sex” by biology—not identity.

The Court ruled that the word “sex” in Title IX means biological sex: a huge win for reality and common sense. It also ruled that the Equal Protection Clause allows states to protect women’s sports, reversing court rulings that sided with gender activists and forced states to let men compete with women.

This is a victory for every girl who refused to stay quiet in the face of injustice. Men cannot be women, and no drug erases the male athletic advantage. I'm grateful to Attorneys General @Raul_Labrador and @mccuskeyforwv and our clients for their courage in defending basic biological truth.

Policies that ignore that truth hurt people—especially women and girls. In West Virginia, plaintiff B.P.J. defeated more than 470 girls over 1,400 times, won the women’s state championship in shot put, and sexually harassed our client Adaleia Cross in the girls’ locker room.

After today’s decision, the 27 states that have enacted laws protecting women’s sports can confidently enforce them. And the 23 states still on the sidelines have run out of excuses.

Landlords stop maintaining buildings because there is no return on investment. Developers stop building new housing because it is not profitable. The housing supply shrinks. The shortage gets worse.
