⚖️ CAPF Act 2026 vs Supreme Court Verdict: Why Is the IPS Deputation Row Heating Up?

Who should lead India’s Central Armed Police Forces—the IPS officers brought in on deputation or the CAPF cadre officers who have spent years serving within these forces?

This question is at the heart of the growing debate over the CAPF Act, 2026.

🏛️ The Centre has defended the new law, arguing that IPS officers bring crucial experience in policing, counter-insurgency, intelligence and coordination with state governments—skills it considers important for managing internal security.

But CAPF cadre officers fear that continued deputation could restrict their promotion opportunities and their chances of reaching the highest leadership positions.

📌 The dispute follows the Supreme Court’s May 2025 verdict, which directed the government to gradually reduce IPS deputation up to the Inspector General (IG) level in five forces: CRPF, BSF, CISF, ITBP and SSB.

The new law, however, lays down specific requirements:

50% of IG posts to be filled through deputation.
At least 67% of ADG posts to be filled through deputation.
All Special DG and DG posts to be filled exclusively through deputation.
The Centre maintains that Parliament has changed the legal framework rather than declared the earlier judgment invalid. It has asked the Supreme Court to dismiss petitions challenging the law, filed by more than 800 serving CAPF officers.

Meanwhile, cadre reviews are underway across all five forces, while retired CAPF officers and their families are planning a protest at Jantar Mantar in November.

🔎 The Supreme Court’s decision could shape the future of CAPF leadership, promotion pathways and the balance between deputation and cadre-based progression.
