To the Honorable Congressman @PeteSessions: It has been brought to my attention that at a recent town hall event, you asked the question "Let's say you get the blue sheets for $MMTLP, what are you going to do next?" The answer is actually quite simple, sir. But first, allow me to clearly lay out what it is we are going after, what we would do with this information, and why it is of paramount importance that there be Congressional intervention.
First and foremost, and with utmost respect, the first move should be for a Congressional member to subpoena an AUDITED SHARE COUNT. An aggregated audited share count from each broker dealer would provide the number of shares that each of them is obligated to deliver to their clients. But the count MUST be independently audited, and MUST contain the amount of shares each broker was allotted, as well as the amount of shares they are liable to deliver to their clients. This would require NO analysis, and subsequently, would cost Congress NOTHING.
When the share count imbalance is revealed, then the next question is “how did this happen?”, and the next step would be to subpoena the blue sheets to be able to ascertain that from the trading data. If indeed there is an imbalance, the expense of Congress paying for the blue sheets to be analyzed would be justified, because at that point it becomes a matter of national security as I can assure you this is not the only stock they are doing this to. ANY member of Congress attached to an effort that would uncover such a massive fraud that is stripping the American public of their savings and wealth would be lauded as a hero.
Now, speaking for myself, when this imbalance is revealed through concrete data such as an audited share count, right then and there, I would file a lawsuit in a court of competent jurisdiction against FINRA, and if needed, Next Bridge Hydrocarbons (I stress IF NEEDED). The causes of action may include, but not be limited to the following: Breach of contract, negligence, securities fraud, and unjust enrichment.
Through this claim, I would be seeking injunctive relief, requesting a court order to compel cooperation between FINRA (and all of its participants) and Next Bridge Hydrocarbons (NBH would more than likely do so willingly) to initiate a temporary trading period for reconciliation of the shares through the use of the market. I would also seek declaratory judgment in the form of a court declaration, confirming the rights and obligations of the parties involved, particularly regarding the correct number of shares to be delivered and the process for reconciliation. I PROMISE you, I would not be alone in filing this claim.
So you see, Mr. Sessions, and Honorable Members of @FinancialCmte and @FSCDems, if only you would just subpoena an independently audited share count from every broker dealer involved, you could end this whole situation, and at no expense. If we are wrong, the share count would show it, and we can all go home. But we are not. And that means that by delving further into it, your names would be etched in history as having been responsible for helping to uncover, and STOP (because I'm sure you would pass legislation to do it) a massive fraud against the investing public like this from ever happening again.
No matter the outcome, it is win/win for all parties involved. For us, for you, and for all of your constituents that have even one dollar invested in the U.S. Stock Market. So I ask you, Honorable Members of #Congress, which of you will stand up for your constituents, stand up for your country, and RISE UP to the fundamental purpose for which your role in government was created? It all starts with a subpoena for the audited share count. We are here, and we shall remain here, fighting at every avenue with unwavering determination and resolve, until we see it.
