Recently I joined a High Court session online to hear how matrimonial cases are handled. Read all 3 cases...
🔹️Case 1
▪️Wife's Lawyer: "Parties have been separated since 2003. There is no child. Wife filed for divorce alleging cruelty where she was made to do rigorous household work. Family Court rejected divorce stating no cruelty was proven. Despite no co-habitation since 20-years, husband is not consenting to divorce"
▪️HC: Both parties summoned for mediation on next date (after 3 months)
🔹️Case 2:
▪️Husband's Lawyer: "Parties have been separated since 8-years. Wife left on her home, not willing to come back, nor giving divorce. She is demanding Rs 5 lakh, my client is very poor, can give max upto Rs 1 lakh."
▪️Judge to Wife: "Madam, please be reasonable and come to middle amount. You can keep filing multiple cases but will not get anything in hand. It will be wise to settle it mutually."
▪️Wife reluctantly agrees to settle. Judge orders Rs 2 lakh, to be paid in Rs 50K installments over next one year.
▪️Judge warns wife: "If you take money, and go back on your word after being brainwashed by your lawyer, you will have to return entire money back to husband." (Wife's lawyer was standing next to her in court)
🔹️Case 3:
▪️Husband walks in with his daughter. He has been fighting for divorce for past 18-years, but has moved on with his partner.
▪️This young girl is his biological daughter with partner, while estranged wife refuses to consent for divorce. Next date given since both parties not mutually agreeable for settlement

🔹️The above cases only demonstrate how outdated, archaic & rotten our matrimonial laws are. These laws are not meant for justice. They aide one of the disgruntled party to satisfy their ego, thereby allowing both side lawyers to make merry.
🔹️While India has decriminalised adultery in 2018, we still want to present picture perfect images when it comes to Indian Marriages.
