Before I begin talking about India and Indian politics and policy that happened on May 1, I would like to say that I saw that for many months many top leaders from the BJP and the Prime Minister of India, #NarendraModi, and his ministers appeared to have soft spots for the USA and its president, #DonaldTrump, as no one strong responded to any of Donald Trump's statements on #tariffs, visa, the India-Pakistan case file, and the most recent "hellhole" against India, including Narendra Modi's political career, as Donald Trump made the remark that he "doesn't want to destroy" Indian Modi's political career during a #WhiteHouse press conference on October 15, 2025.
And here, I am going to provide you with compelling evidence for my assertion in the first paragraph that BJP leaders, Indian Prime Minister Narendra Modi, and his ministers seemed to have soft spots for the United States of America (USA) and its president, Donald Trump, as #BJP leader #RamMadhav stated, 'India agreed to stop buying oil from Iran. We agreed to stop buying oil from #Russia despite so much criticism from our opposition. India agreed to a 50% tariff without saying too much. So where exactly is India not doing enough to work with America?”
But the more pressing question is why, despite being in the United States of America, he did not respond strongly to Donald Trump's "#hellhole" statement. And the silence of #politicians and #bureaucrats on the "hellhole" statement indicates that many politicians' and bureaucrats' children live in the United States of America (USA) and if they speak, they may not be granted a visa to visit the USA.
Since then, the United States of America has tightened visa policies, requiring extensive social media vetting for F, M, and J (student/exchange) visas, where public posts deemed "anti-American", supportive of extremism, or protesting US foreign policy can lead to denial, visa revocation, or deportation.
F, M, and J are non-immigrant visas that allow for temporary stays in the USA. The F-1 visa is for academic students, the M-1 visa is for vocational/non-academic students, and the J-1 visa is for exchange visitors. F/M visas require SEVP-certified school acceptance, whereas J-1 visas require a specific sponsor.
But at the same time, I have noticed that the opposition has failed to comprehend Ram Madhav's irresponsible April 24th statement, which has severely harmed India's reputation. I have also noticed that a few people from the opposition camp, who regularly hold press conferences in the #PressClub over #votechori issue, have shared 2015 old video on #May1 and 2 without captions to counter Ram Madhav, which is creating more confusion about their intensity because they shared a video on Twitter of Ram Madhav speaking with #MehdiHasan in an episode of Head to Head, which is #AlJazeera's forum of ideas.
Let us get right to the point. Senior Supreme Court Advocate #AbhishekManuSinghvi is representing Congress leader Pawan Khera in a case that reminds me of the famous legal Netflix series dialogue: "Before you can win, you've got to act like you can win, which means you've got to believe you can win."
Therefore, I strongly believe that because of Advocate Abhishek Manu Singhvi's strong and powerful arguments on April 30, Pawan Khera was granted anticipatory bail by the Supreme Court on April 30 in a case involving alleged forgery and defamation related to making false accusations against Assam Chief Minister Himanta Biswa Sarma's wife, #RinikiBhuyanSharma.
In the case of PAWAN KHERA vs STATE OF ASSAM, the Supreme Court's bench of Justices #JKMaheshwari and #AtulChandurkar's order was uploaded on the Supreme Court's official website, but Pawan Khera's anticipatory bail news came on May 1, and the Congress even held a press conference on May 1 after #PawanKhera received bail from the Supreme Court.
However, I continue to wonder why Senior Supreme Court Advocate Abhishek Manu Singhvi used the words "I would request the Honourable CM with folded hands" during a live press conference on May 1 at 2pm at the party's old headquarters on #24AkbarRoad in #NewDelhi. If you don't believe the words, you can watch and listen to what Abhishek Manu Singhvi said during a press conference from 6:56 to 7:07 on the official YouTube channel of Congress.
Advocate Abhishek Manu Singhvi is also a Congress Rajya Sabha MP for the fifth consecutive term and the chairman of the Congress legal wing.
I would like to clarify that, while I am not a lawyer or a legal expert, I have a basic understanding of legal concepts and the power of words after reading legal-related content on #Google and watching #legal-related #Netflix series.
Therefore, I think the Supreme Court bench of Justices JK Maheshwari and Atul S. Chandurkar was persuaded when Senior Supreme Court Advocate Abhishek Manu Singhvi stated in front of the Supreme Court bench on April 30 that the charges invoked against Pawan Khera are bailable, including Section 339 (forgery under BNS), which he claims was wrongly added later and does not even form part of the original FIR.
On the other hand, during an argument before the Supreme Court bench, Singhvi sharply criticised statements attributed to Assam Chief Minister Himanta Biswa Sarma, claiming that he is acting as a constitutional #cowboy.
During an argument before a Supreme Court bench on April 30, Advocate Abhishek Manu Singhvi stated, "Please see the published articles on Assam Chronicle with the unprintable word right in the middle...Please see page nos.76, 77, 78 is this 'Peda' thing. He says, 'peda bana dunga'.Then he goes on saying 'Pelunga'...Dr. Ambedkar would turn over in his grave if he had imagined a constitutional holder of office behaving like a constitutional cowboy, a constitutional Rambo."
In his argument on April 30, Advocate Abhishek Manu Singhvi added that the core of the allegations involved reputational damage, which did not legally necessitate a custodial arrest. Since travel documents were easily monitored, there was no credible flight risk. The necessity for arrest appeared to stem from the state's political angst rather than a legitimate investigative requirement.
Advocate Abhishek Manu Singhvi questioned why the state bypassed the Magistrate to seek a non-bailable warrant, suggesting that the primary goal was to humiliate Khera through a custodial arrest.
Advocate Abhishek Manu Singhvi further said that the various legal sections invoked by the Investigating Officer were "thrown in" to justify detention despite the lack of evidence regarding absconding or tampering. And Advocate Abhishek Manu Singhvi concluded that if anticipatory bail were denied in such a context, the very purpose of the legal protection would be rendered meaningless.
Additionally, I believe that Solicitor General Tushar Mehta, who represented the Assam government before a bench of Justices JK Maheshwari and Atul S. Chandurkar, failed to defend Senior Advocate Abhishek Manu Singhvi's strong argument, which he did on April 30 for his client Pawan Khera.
The Solicitor General of India (SGI) #TusharMehta, representing the Assam government, defended the need for custodial interrogation in the case, citing the "seriousness of the allegations" levelled against Pawan Khera.
"The Appellant has been made an accused in connection with FIR No. 04/2026 dated 06.04.2026 registered by the Crime Branch Police Station, Guwahati under Sections 175, 3(5), 3(6), 318, 336(4), 337, 338, 340, 341(1), 351(1), 352, 353, 356, and 61(2) of Bharatiya Nyaya Sanhita, 2023 (hereinafter, ‘#BNS’)," a doucnemnt stated.
While Congressman Pawan Khera was granted anticipatory bail by the Supreme Court, a bench of Justices J K Maheshwari and Atul Chandurkar stated that after perusal of the aforesaid statements, we are of the view that the allegations and counter allegations have been made by the Appellant as well as by the husband of the complainant. Learned Solicitor General has not defended any of such statements during the course of hearing, nor is the veracity of the same questioned.
The Supreme Court, a bench of Justices J K Maheshwari and Atul Chandurkar, stated that at this stage, we are cognizant of the fact that personal liberty of an individual enshrined under Article 21 of the Constitution of India cannot be put to jeopardy lightly. But at the same time, we are also of the view that for any offences as alleged in the FIR, the investigation should be completed with integrity and in full swing with co-operation of the Appellant.
The Supreme Court, a bench of Justices J K Maheshwari and Atul Chandurkar, went on to say that Having regard to the aforesaid considerations, we are of the opinion that while adjudicating an application for anticipatory bail, a careful balance must be struck between the State’s interest in ensuring a fair investigation and the individual’s fundamental right to personal liberty under #Article21 of the Constitution of India, in light of the principles enunciated in Gurbaksh Singh Sibbia (supra). In this context, the criminal process must be applied with objectivity and circumspection so as to ensure that individual liberty is not imperiled by proceedings that may be coloured by political rivalry. We are further of the opinion that the allegations and counter-allegations, as apparent in the present case, prima facie, appear to be politically motivated and seemingly influenced by such rivalry, rather than disclosing a situation warranting custodial interrogation, and the veracity of the allegations can be tested at trial. The right to personal liberty is a cherished fundamental right, and any deprivation thereof must be justified on a higher threshold, particularly where the surrounding circumstances may indicate the presence of political overtones.
