AG Garland's speech today attempts a defense of the "independent DOJ." It's just an extended response to my paper, linked to below, which I again recommend my followers (and anyone and everyone) read. The Department of Justice is NOT independent. The Department of Justice is not mentioned in the Constitution. So it could not have such a status based on constitutional law. Indeed, it's the opposite. The President is the Chief Law Enforcer of the United States, not the Attorney General, as I explain in the paper, and which the Supreme Court recognized in Trump v. United States issued on July 1, 2024. The Executive Branch is the only one of the three Branches where all power is reposed in a singular person: the President of the United States. And the President's most significant power -- to enforce the laws -- is contained in the Take Care Clause of Article II of the Constitution. There is no AG Take Care Clause in that document. Nor did Congress make the Justice Department independent by statute. So DOJ cannot claim independent status based on statutory law either. (And were Congress to try to make DOJ independent by statute, that would violate Article II's Take Care Clause and the separation of powers and be unconstitutional.) Bottom line, there is no basis in law -- anywhere -- for saying that the Justice Department is independent of the President. None. Zero. Nada. This is why AG Garland argues that DOJ independence is a "norm." But "norms" are not the Constitution. They are not any form of law. It is shocking that a Senate-confirmed Attorney General would fail to recognize the superior authority of the Constitution. And it is even more shocking that an audience of Senate-confirmed U.S. Attorneys would applaud him as he rejects the Constitution in favor of a mere "norm." "Norms" are what Democrats tried to foist on the Presidency and the Justice Department in the wake of a Watergate window of opportunity. The period of rule by "norms" as opposed to constitutional law will come to an end if President Trump is reelected. Please stop reading mainstream press. You've been misled. including by your grade and high school teachers if you were educated after Watergate and your teachers were not exceptionally well-steeped in real constitutional law. Under Article II of the Constitution, the Justice Department, like all Cabinet departments, is dependent, not independent. Read the paper instead.
