Bharatiya Nagarik Suraksha Sanhita, 2023 – Section 232
(Commitment of Cases Triable Exclusively by the Court of Session)
When, in a case instituted on a police report or otherwise, the accused appears or is brought before a Magistrate, and it appears to the Magistrate that the offence is one which is exclusively triable by the Court of Session, he shall—
(a) after complying with the provisions of Section 230 or Section 231, commit the case to the Court of Session and, subject to the provisions of this Sanhita relating to bail, remand the accused to custody until such commitment has been made;
(b) subject to the provisions of this Sanhita relating to bail, remand the accused to custody during, and until the conclusion of, the trial;
(c) send to that Court the record of the case and the documents and articles, if any, which are to be produced in evidence;
(d) notify the Public Prosecutor of the commitment of the case to the Court of Session.
First Proviso
The proceedings under this section shall be completed within ninety (90) days from the date of taking cognizance of the offence.
However, for reasons to be recorded in writing, the Magistrate may extend this period up to a maximum of one hundred and eighty (180) days.
Second Proviso
In a case triable by the Court of Session, if any application has been filed before the Magistrate by the accused, the victim, or any person authorized by them, such application shall also be forwarded to the Court of Session along with the committal of the case.
Simple Explanation
The purpose of this section is to ensure that serious offences such as murder, rape, robbery, and other grave crimes, which by law are triable only by a Court of Session, are transferred to the appropriate court for trial.
Even if such cases are initially brought before a Magistrate, the Magistrate cannot conduct the trial himself. Instead, after complying with the necessary procedural requirements and supplying the relevant documents, the Magistrate must commit the case to the Court of Session.
Furthermore:
The committal proceedings must be completed within 90 days;
An extension up to 180 days may be granted only if valid reasons are recorded in writing;
Any applications filed by the accused or the victim and pending before the Magistrate must also be forwarded to the Court of Session;
This provision ensures that serious criminal cases reach the competent court for trial without unnecessary delay.
Corresponding Provision Under the Previous Law
Section 232 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) corresponds to Section 209 of the Code of Criminal Procedure, 1973 (CrPC).
However, the introduction of a 90-day time limit for committal proceedings and the mandatory forwarding of pending applications to the Court of Session are significant changes incorporated under the new law.
